NFDA works with relevant federal departments/agencies and Congress to support and/or advocate for legislation, rules and regulations that ensure the consensual donation and respectful disposition of human bodies and non-transplantable human body parts donated for education, research, and the advancement of medical, dental and mortuary science for research purposes. Including support The Consensual Donation and Research Integrity Act (S. 1270/H.R. 2589), which aims to bring federal oversight to the currently unregulated industry of whole-body donation.

Specifically, issues related to small business and tax related issues including Death Tax Repeal Act and including final expenses as a qualified expense in health savings accounts. Including support of Funeral Coverage Act (H.R. 2436); and Death Tax Repeal Act of 2025 (S. 587/H.R. 1301)

Specifically, EPA and OSHA issues affecting funeral service, including issues related to formaldehyde exposure and use in embalming and the EPA TSCA Risk Evaluation. Including support of No IRIS Act of 2025 (S. 623/H.R. 1415):
