AN ACT
1 Amending the act of March 4, 1971 (P.L.6, No.2), entitled "An
2 act relating to tax reform and State taxation by codifying
3 and enumerating certain subjects of taxation and imposing
4 taxes thereon; providing procedures for the payment,
5 collection, administration and enforcement thereof; providing
6 for tax credits in certain cases; conferring powers and
7 imposing duties upon the Department of Revenue, certain
8 employers, fiduciaries, individuals, persons, corporations
9 and other entities; prescribing crimes, offenses and
10 penalties," in tax credit and tax benefit administration,
11 further providing for definitions; and providing for green
12 roof tax credit.
13 The General Assembly of the Commonwealth of Pennsylvania
14 hereby enacts as follows:
15 Section 1. The definition of "tax credit" in section 1701-
16 A.1 of the act of March 4, 1971 (P.L.6, No.2), known as the Tax
17 Reform Code of 1971, is amended by adding a paragraph to read:
18 Section 1701-A.1. Definitions.
19 The following words and phrases when used in this article
20 shall have the meanings given to them in this section unless the
21 context clearly indicates otherwise:

1 "Tax credit." A tax credit authorized under any of the
2 following:

6 Section 2. The act is amended by adding an article to read:
7 ARTICLE XIX-L
8 GREEN ROOF TAX CREDIT
9 Section 1901-L. Scope of article.
10 This article relates to a green roof tax credit.
11 Section 1902-L. Definitions.
12 The following words and phrases when used in this article
13 shall have the meanings given to them in this section unless the
14 context clearly indicates otherwise:
15 "Department." The Department of Revenue of the Commonwealth.
16 "Eligible rooftop space." The total space available to
17 support a green roof, as certified by a structural engineer.
18 "Green roof." An addition to a roof that supports living
19 vegetation and includes a synthetic, high-quality waterproof
20 membrane, drainage layer, soil layer and lightweight medium
21 plants.
22 "Tax credit." The credit provided under this article.
23 "Tax liability." For a taxpayer who is an individual, taxes
24 imposed under Article III and for all other taxpayers, taxes
25 imposed under Articles III, IV and VI.
26 Section 1903-L. Application.
27 A business or individual seeking a tax credit must file an
28 application with the department that includes the following:
29 (1) The address location of the proposed green roof.
30 (2) The total square footage of the rooftop.

1 (3) The total square footage of the eligible rooftop
2 space.
3 (4) The total square footage of the proposed green roof.
4 (5) The total projected costs to construct the green
5 roof.
6 (6) Proof that the applicant has received all required
7 permits and approvals to construct the green roof, after
8 first submitting to the local building code official the
9 plans for the green roof and a written analysis conducted by
10 a roof engineer that confirms and certifies the following:
11 (i) The condition of the roof is satisfactory for
12 green roof construction.
13 (ii) The structural capacity of the roof would
14 support the proposed green roof.
15 (iii) There is appropriate and safe access to the
16 roof for maintenance purposes.
17 (iv) The weight of the proposed green roof is
18 appropriate for the roof.
19 (v) The plans include appropriate irrigation and
20 drainage measures.
21 Section 1904-L. Commitment agreement.
22 The department shall approve an application for a tax credit
23 if the application contains all of the required information.
24 After approval, the applicant must execute a commitment
25 agreement with the department specifying the following:
26 (1) The plans for the green roof, as approved by the
27 local building code official, which must provide for a green
28 roof covering at least 50% of the building's rooftop or 75%
29 of eligible rooftop space.
30 (2) The total projected costs for the construction of

1 the green roof.
2 (3) The maximum tax credit the applicant may claim.
3 (4) The applicant's commitment to maintain the green
4 roof for a period of five years after the date of the roof's
5 completion and the applicant's acknowledgment that if the
6 taxpayer claims a tax credit and fails to incur the amount of
7 qualified construction or maintenance costs for a green roof
8 in that taxable year, the taxpayer shall repay to the
9 Commonwealth the amount of the tax credit claimed under this
10 article for the green roof.
11 Section 1905-L. Certification and credit.
12 (a) Credit.--After the applicant and the department have
13 executed a commitment agreement, and upon certifying to the
14 department the total costs actually incurred and proof of
15 completion of the green roof in accordance with the plans set
16 forth in the commitment agreement, the applicant may claim a
17 credit against the tax liability of the applicant equal to 25%
18 of all costs initially incurred to construct the green roof and
19 for maintenance in the years after.
20 (b) Limitations.--
21 (1) The amount of tax credits awarded to an individual
22 or business may not exceed $100,000 in any fiscal year.
23 (2) The tax credit shall be applied against the
24 applicant's total tax liability subject to the tax credit for
25 the fiscal year during which the applicant certifies the
26 completion of the green roof.
27 (3) Any unused credits may be carried forward until
28 fully used.
29 (4) The credit is not a refundable credit.
30 (5) The credit is nontransferable.

1 (c) Availability of tax credits.--Each fiscal year,
2 $10,000,000 in tax credits shall be made available to the
3 department and may be awarded by the department in accordance
4 with this article.
5 Section 1906-L. Repayment of tax credits.
6 A business or individual that has received and taken the
7 credit must repay the credit to the Commonwealth if the business
8 or individual fails to maintain the green roof in accordance
9 with the provisions of the commitment agreement.
10 Section 3. This act shall take effect in 60 days.
