                                       AN ACT
 1   Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
 2      Statutes, in food protection, further providing for
 3      misbranding of food.
 4      The General Assembly of the Commonwealth of Pennsylvania
 5   hereby enacts as follows:
 6      Section 1.      Section 5729(a) of Title 3 of the Pennsylvania
 7   Consolidated Statutes is amended by adding a paragraph and the
 8   section is amended by adding a subsection to read:
 9   § 5729.    Misbranding of food.
10      (a)    General rule.--A food shall be misbranded:
11             * * *
12             (13)    If it bears or contains Butylated Hydroxyanisole
13      (CAS 25013-16-5) unless it bears the following warning, in
14      boldface type, on the principal display panel and in a type
15      size no smaller than the type size used for the "serving
16      size" declaration required by Federal law:
1               WARNING: This product contains BHA, which may cause
2               cancer.
3      * * *
4      (d)   Definition.--As used in this section, the term "CAS"
5   means the unique accession number assigned by the Chemical
6   Abstracts Service, a division of the American Chemical Society,
7   as of the effective date of this section, to a substance.
8      Section 2.   This act shall take effect in one year.
