                                      AN ACT
 1   Amending Title 18 (Crimes and Offenses) of the Pennsylvania
 2      Consolidated Statutes, in abortion, providing for prohibition
 3      against cooperation with out-of-State abortion
 4      investigations.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7      Section 1.      Title 18 of the Pennsylvania Consolidated
 8   Statutes is amended by adding a section to read:
 9   § 3208.2.      Prohibition against cooperation with out-of-State
10                  abortion investigations.
11      (a)   Prohibition.--The applicable individuals and entities in
12   subsection (b) may not provide any information nor expend or use
13   time, money, facilities, property, equipment, personnel or other
14   resources in furtherance of any interstate investigation or
15   proceeding seeking to impose civil or criminal liability upon an
16   individual or entity for:
17            (1)    The provision, seeking or receipt of or inquiring
18      about abortion or its related activity, that is legal in this
 1      Commonwealth.
 2            (2)   Assisting an individual or entity providing,
 3      seeking, receiving or responding to an inquiry about abortion
 4      and its related activity, that is legal in this Commonwealth.
 5      (b)   Applicable individuals and entities.--The prohibition
 6   under subsection (a) shall apply to the following individuals
 7   and entities:
 8            (1)   A Commonwealth government entity.
 9            (2)   A law enforcement agency.
10            (3)   A peace officer.
11            (4)   A political subdivision of the Commonwealth or a
12      municipal or any other local authority, including its
13      officers, agencies, employees and contractors.
14      (c)   Exception.--This section does not apply to an
15   investigation or proceeding if the conduct of the investigation
16   or proceeding would be a violation of the laws of this
17   Commonwealth.
18      (d)   Definitions.--As used in this section, the following
19   words and phrases shall have the meanings given to them in this
20   subsection unless the context clearly indicates otherwise:
21      "Commonwealth government entity."       The term shall have the
22   same meaning as the term "Commonwealth government" under 2
23   Pa.C.S. § 101 (relating to definitions).
24      "Law enforcement agency."      Any of the following:
25            (1)   The Pennsylvania State Police.
26            (2)   The Pennsylvania Capitol Police.
27            (3)   The Harrisburg International Airport Police.
28            (4)   An airport authority police department.
29            (5)   A county park police force under 16 Pa.C.S. §
30      16511(b) (relating to employees and police).

 1          (6)   A public agency of a political subdivision having
 2      general police powers and charged with making arrests in
 3      connection with the enforcement of the criminal or traffic
 4      laws, including the sheriff's office in a county of the
 5      second class.
 6          (7)   A campus police or university police department.
 7          (8)   A railroad or street railway police department.
 8          (9)   Any other individual or entity engaged in a law
 9      enforcement action.
10      "Peace officer."   As defined in section 501 (relating to
11   definitions).
12      Section 2.   This act shall take effect in 60 days.
