                                      AN ACT
 1   Amending Title 34 (Game) of the Pennsylvania Consolidated
 2      Statutes, in hunting and furtaking licenses, further
 3      providing for elk hunting licenses.
 4      The General Assembly of the Commonwealth of Pennsylvania
 5   hereby enacts as follows:
 6      Section 1.      Section 2706.2 of Title 34 of the Pennsylvania
 7   Consolidated Statutes is amended by adding a subsection to read:
 8   § 2706.2.      Elk hunting licenses.
 9      * * *
10      (e)   Transfer.--
11            (1)    A recipient selected to receive a license under
12      subsection (b) or (c) may transfer the license to an eligible
13      hunter as provided under this subsection.
14            (2)    The commission shall provide for the form and manner
15      in which a license may be transferred under this subsection,
16      including the manner in which a transferee must prove that
17      the transferee meets the requirements of this subsection.
18            (3)    The transfer of a license under this subsection may
 1    not result in monetary gain. An individual making a transfer
 2    may be reimbursed for the cost of the license and any
 3    additional cost imposed by the commission for the transfer.
 4        (4)   An individual transferring a license or receiving a
 5    transferred license in violation of this subsection shall be
 6    subject to all of the following:
 7              (i)    A civil penalty of $10,000.
 8              (ii)    The suspension of each privilege granted by
 9        this title for a period of five years.
10              (iii)    A permanent ban from applying for an elk
11        license.
12              (iv)    The loss of accumulated bonus or preference
13        points by the recipient of a license under this section.
14              (v)    The confiscation of any animal taken.
15    Section 2.      This act shall take effect in 60 days.
