AN ACT
1 Amending Title 66 (Public Utilities) of the Pennsylvania
2 Consolidated Statutes, in rates and distribution systems,
3 further providing for alternative ratemaking for utilities.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 1330(b) of Title 66 of the Pennsylvania
7 Consolidated Statutes is amended by adding a paragraph to read:
8 § 1330. Alternative ratemaking for utilities.

10 (b) Alternative rate mechanisms.--

12 (4) An alternative rate mechanism may not be based on
13 expected temperatures, including weather normalization
14 adjustments. Any alternative rate mechanism that is based on
15 expected temperatures and approved by the commission shall be
16 unenforceable and the utility shall apply the base rate to
17 any customer that was previously charged an alternative rate
18 mechanism based on expected temperatures.

2 Section 2. This act shall take effect in 60 days.
