                                     AN ACT
 1   Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
 2      act to consolidate, editorially revise, and codify the public
 3      welfare laws of the Commonwealth," in public assistance,
 4      providing for subscription model for GLP-1 agonists.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7      Section 1.    The act of June 13, 1967 (P.L.31, No.21), known
 8   as the Human Services Code, is amended by adding a section to
 9   read:
10      Section 449.3.    Subscription Model for GLP-1 Agonists.--(a)
11   The department shall seek a waiver from the Centers for Medicare
12   and Medicaid Services of the United States Department of Health
13   and Human Services to permit the Commonwealth to enter into
14   value-based arrangements with drug manufacturers through
15   supplemental rebate agreements for GLP-1 agonists used to treat
16   obesity.
17      (b)     Subject to Federal approval, the department shall
18   promulgate regulations to implement this section.
 1      (c)     As used in this section, the following words and phrases
 2   shall have the meanings given to them in this subsection unless
 3   the context clearly indicates otherwise:
 4      "GLP-1 agonist."     A type of medication which mimics the
 5   effect of the GLP hormone on the body, including the following
 6   effects:
 7      (1)     Triggering insulin release from the pancreas.
 8      (2)     Blocking glucagon secretion.
 9      (3)     Slowing the emptying of the stomach.
10      (4)     Increasing how full an individual feels after eating.
11      "Supplemental rebate agreement."       An agreement between the
12   Commonwealth and a drug manufacturer which allows the
13   Commonwealth to pay an agreed amount per treatment provided up
14   to a cap, at which point treatments are provided at no cost to
15   the Commonwealth.
16      Section 2.     This act shall take effect in 60 days.
