                                       AN ACT
 1   Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
 2      act relating to the public school system, including certain
 3      provisions applicable as well to private and parochial
 4      schools; amending, revising, consolidating and changing the
 5      laws relating thereto," establishing the Lifeline Scholarship
 6      Program and the Lifeline Scholarship Fund; and conferring
 7      powers and imposing duties on the State Treasury and Auditor
 8      General.
 9      The General Assembly of the Commonwealth of Pennsylvania
10   hereby enacts as follows:
11      Section 1.     The act of March 10, 1949 (P.L.30, No.14), known
12   as the Public School Code of 1949, is amended by adding an
13   article to read:
14                               ARTICLE XVII-E
15                        LIFELINE SCHOLARSHIP PROGRAM
16   Section 1701-E.    Scope of article.
17      This article relates to the Lifeline Scholarship Program.
18   Section 1702-E.    Definitions.
19      The following words and phrases when used in this article
20   shall have the meanings given to them in this section unless the
 1   context clearly indicates otherwise:
 2      "Applicant."      A parent who applies for participation in the
 3   program under section 1704-E on behalf of an eligible student.
 4      "Attendance boundary."     As defined in section 2002-B.
 5      "Department."     The Department of Education of the
 6   Commonwealth.
 7      "Eligible student."     A school-age child who:
 8          (1)   Is a resident of this Commonwealth.
 9          (2)   Has not received a high school diploma.
10          (3)   Satisfies at least one of the following:
11                (i)    Resides, as determined under section 1302,
12          within the attendance boundary of a low-achieving school
13          or resided, as determined under section 1302, within the
14          attendance boundary of a low-achieving school at the time
15          the State Treasury received written confirmation that the
16          child accepted an offer of enrollment under section 1704-
17          E.
18                (ii)    Lives in a household with a household income
19          below 350% of the Federal poverty guidelines or lived in
20          a household with a household income below 350% of the
21          Federal poverty guidelines at the time the State Treasury
22          received written confirmation that the child accepted an
23          offer of enrollment under section 1704-E.
24          (4)   Satisfies one of the following:
25                (i)    Attended a public school in this Commonwealth in
26          the preceding school year.
27                (ii)    Received a scholarship from the program in the
28          preceding school year.
29                (iii)    Will attend kindergarten for the first time in
30          the next school year.

 1      "Fund."      The Lifeline Scholarship Fund established in section
 2   1708-E.
 3      "Kindergarten."     A one-year formal educational program,
 4   whether part time or full time, that occurs during the school
 5   year immediately prior to first grade.
 6      "Lifeline scholarship account."       A spending account
 7   established and administered by the State Treasury and directed
 8   by a parent for a scholarship recipient that may be used for
 9   tuition, school-related fees and special education services fees
10   to attend a participating nonpublic school.
11      "Low-achieving school."     As defined in section 2002-B.
12      "Nonpublic school."     A nonprofit school, other than a public
13   school, located in this Commonwealth where a resident of this
14   Commonwealth may legally fulfill the compulsory attendance
15   requirements of this act.
16      "Parent."     An individual who is a resident of this
17   Commonwealth and:
18             (1)   has legal custody or guardianship of an eligible
19      student; or
20             (2)   keeps in the individual's home an eligible student
21      and supports the student gratis as if the student were a
22      lineal descendant of the individual.
23      "Participating nonpublic school."       A nonpublic school
24   offering a program of instruction for kindergarten through grade
25   twelve, or a combination of grades, that:
26             (1)   notifies the State Treasury of the nonpublic
27      school's desire to participate in the program; and
28             (2)   provides certification to the State Treasury that
29      the nonpublic school meets the criteria under section 1711-
30      E(a).

 1      "Program."   The Lifeline Scholarship Program established
 2   under section 1703-E(a).
 3      "Public school."    A school operated by a school district, an
 4   intermediate unit, area career and technical school, charter
 5   school, regional charter school or cyber charter school.
 6      "Resident school district."     The school district in which an
 7   eligible student resides.
 8      "Scholarship."   A scholarship that is awarded to an eligible
 9   student under the program.
10      "Scholarship recipient."     An eligible student who is awarded
11   a scholarship under the program.
12      "School-age child."     A child enrolling in kindergarten or in
13   grades one through twelve.
14      "School-related fee."     A fee charged by a participating
15   nonpublic school to:
16          (1)   all students for books, instructional materials,
17      technology equipment and services, uniforms, activities and
18      concurrent enrollment programs; or
19          (2)   scholarship recipients for additional education-
20      related resources, supplemental instruction or interventions
21      to help scholarship recipients achieve grade-level
22      expectations.
23      "School year."   A school term as defined in section 102.
24      "Special education services fee."       A fee charged by a
25   participating nonpublic school for special education services
26   for a student with special needs as agreed to by the parent and
27   the participating nonpublic school.
28      "State Treasury."   The Treasury Department of the
29   Commonwealth.
30      "Student with special needs."        A child who is subject to an

 1   individualized education program under 20 U.S.C. Ch. 33
 2   (relating to education of individuals with disabilities) and 22
 3   Pa. Code Ch. 14 (relating to special education services and
 4   programs).
 5   Section 1703-E.        Lifeline Scholarship Program.
 6      (a)   Establishment.--Beginning with the 2026-2027 school
 7   year, the Lifeline Scholarship Program is established as a
 8   program in the State Treasury to provide scholarships to help
 9   eligible students pay tuition, school-related fees and special
10   education services fees for attendance at a participating
11   nonpublic school.
12      (b)   Notice to parents.--
13            (1)   Within 15 days of receipt of a notice under section
14      2010-B, a school district with a school designated as a low-
15      achieving school shall notify the parent of a student who is
16      attending or residing within the attendance boundary of the
17      low-achieving school during the school year of the school's
18      designation.
19            (2)   The notice shall be in a form provided by the State
20      Treasury, in consultation with the department, and shall
21      provide the following information regarding the program:
22                  (i)    A description of the program.
23                  (ii)    Instructions for obtaining information about
24            applying for a scholarship under the program.
25                  (iii)    A list of any school in the school district
26            that has been designated as a low-achieving school.
27                  (iv)    Notice of the parent's responsibilities
28            regarding application to a participating nonpublic school
29            if the parent seeks to enroll an eligible student in a
30            participating nonpublic school.

 1            (3)   The notice shall be posted on the school district's
 2      publicly accessible Internet website.
 3      (c)   Notice to State Treasury.--A school district required to
 4   submit a notice to parents under subsection (b) shall provide
 5   the State Treasury with a list of students whose parents were
 6   provided the notice. The notification shall be made in a manner
 7   and form established by the State Treasury.
 8   Section 1704-E.    Application.
 9      (a)   Application form.--No later than two weeks after the
10   effective date of this section, the State Treasury shall develop
11   an application form that can be accessed from and submitted
12   electronically on the State Treasury's publicly accessible
13   Internet website.
14      (b)   Application and approval process.--
15            (1)   No later than April 1, 2026, and each April 1
16      thereafter, an applicant may apply to the State Treasury for
17      a scholarship for the following school year according to
18      guidelines developed by the State Treasury under section
19      1709-E. An application shall be approved by the State
20      Treasury if the student meets the eligibility requirements of
21      this article.
22            (2)   A renewal application shall be approved by the State
23      Treasury if the student meets the eligibility requirements of
24      this article, notwithstanding the residence or income
25      criteria specified in paragraph (3) of the definition of
26      "eligible student" in section 1702-E.
27            (3)   A parent may appeal the State Treasury's decision
28      regarding nonapproval of an application. The appeal shall be
29      governed by 2 Pa.C.S. Chs. 1 (relating to general
30      provisions), 5 (relating to practice and procedure) and 7

 1    (relating to judicial review).
 2        (4)   No later than May 1, 2026, and each May 1
 3    thereafter, the State Treasury shall notify the applicant
 4    whether a scholarship will be awarded for the following
 5    school year.
 6        (5)   For the 2026-2027 school year, scholarships shall be
 7    awarded on a first-come, first-served basis considering money
 8    available in the fund.
 9        (6)   For the 2027-2028 school year, and each school year
10    thereafter, the State Treasury shall give priority for
11    scholarships to prior year scholarship recipients, and shall
12    award scholarships to new applicants on a first-come, first-
13    served basis considering money available in the fund.
14        (7)   Upon notification by the State Treasury that a
15    scholarship has been awarded, the applicant shall apply for
16    enrollment of the scholarship recipient directly to the
17    participating nonpublic school under an application procedure
18    developed by the participating nonpublic school.
19        (8)   No later than June 1, 2026, and each June 1
20    thereafter, a participating nonpublic school shall provide
21    written confirmation to the State Treasury of scholarship
22    recipients who have accepted an offer of enrollment for the
23    following school year and provide the State Treasury with the
24    amounts to be charged to the scholarship recipient for
25    tuition, school-related fees and special education services
26    fees. The notification shall be made in a manner and form
27    established by the State Treasury.
28        (9)   The State Treasury may establish a waiting list for
29    eligible students with approved applications who did not
30    receive awards due to availability of money in the fund and,

 1      if, by July 1, 2026, and by July 1 each year thereafter,
 2      additional money is available in the fund for scholarships,
 3      may award scholarships to the eligible students on a first-
 4      come, first-served basis.
 5   Section 1705-E.    Agreement.
 6      (a)   Authorization.--Upon receipt of written confirmation
 7   that a scholarship recipient has accepted an offer of enrollment
 8   under section 1704-E, the State Treasury must enter into or
 9   renew an agreement with the applicant. The agreement shall
10   provide the following:
11            (1)   The scholarship recipient shall enroll in a
12      participating nonpublic school for the school year for which
13      the agreement applies.
14            (2)   A certain sum of money shall be deposited into a
15      lifeline scholarship account under section 1706-E on behalf
16      of the scholarship recipient.
17            (3)   The money in the lifeline scholarship account may be
18      expended only as authorized under this article.
19            (4)   The parent shall notify the State Treasury if the
20      scholarship recipient no longer resides in this Commonwealth
21      or withdraws or is forced to withdraw from the participating
22      nonpublic school within 15 days of the change of residency or
23      withdrawal.
24      (b)   Term of agreement.--Except as otherwise provided under
25   this article, an agreement entered into under subsection (a)
26   shall be valid for one school year.
27      (c)   Termination.--
28            (1)   An agreement entered into under subsection (a) may
29      be terminated early by the parent for any reason.
30            (2)   An agreement entered into under subsection (a) shall

 1    be terminated by the State Treasury for any of the following
 2    reasons:
 3               (i)    The parent is found to have engaged in
 4        fraudulent misuse of the lifeline scholarship account. In
 5        such case, the scholarship recipient shall be ineligible
 6        for future participation in the program. The parent may
 7        appeal the State Treasury's decision regarding
 8        termination and student eligibility within 30 days of
 9        issuance of the decision. The appeal shall be governed by
10        2 Pa.C.S. Chs. 1 (relating to general provisions), 5
11        (relating to practice and procedure) and 7 (relating to
12        judicial review).
13               (ii)    The scholarship recipient no longer resides in
14        this Commonwealth.
15               (iii)    The scholarship recipient withdraws or is
16        forced to withdraw from a participating nonpublic school
17        prior to the completion of the school year.
18        (3)    If an agreement is terminated under this subsection:
19               (i)    All available money in the lifeline scholarship
20        account shall revert to the fund.
21               (ii)    The participating nonpublic school shall repay
22        to the State Treasury for deposit into the fund the full
23        amount of the scholarship payment, reduced on a pro rata
24        basis by the tuition, school related fees and special
25        education services fees owed for the portion of the
26        school year in which the scholarship recipient was
27        enrolled.
28               (iii)    The participating nonpublic school may not
29        require the parent to reimburse the participating
30        nonpublic school for the amount of the scholarship

 1            returned to the State Treasury.
 2      (d)   Renewal.--An agreement entered into under subsection (a)
 3   may be renewed for each school year for the same student.
 4      (e)   Multiple agreements.--A parent of more than one child
 5   who is a scholarship recipient must enter into a separate
 6   agreement under subsection (a) for each of the children.
 7      (f)   Explanation.--Upon entering into an agreement under
 8   subsection (a) or renewing an agreement under subsection (d),
 9   the State Treasury shall provide the parent with a written
10   explanation of the authorized uses of the money in the lifeline
11   scholarship account.
12   Section 1706-E.        Lifeline scholarship account.
13      (a)   Establishment.--If an agreement is entered into under
14   section 1705-E(a), the State Treasury shall establish a lifeline
15   scholarship account for the scholarship recipient. The lifeline
16   scholarship account shall be administered by the State Treasury
17   in accordance with this article.
18      (b)   Deposit.--
19            (1)   Upon establishment of a lifeline scholarship
20      account, the State Treasury shall deposit a sum of money for
21      the applicable school year in the lifeline scholarship
22      account for the scholarship recipient in accordance with this
23      section.
24            (2)   For the 2026-2027 school year, the sum shall be as
25      follows:
26                  (i)    for a student in half-day kindergarten, $2,500;
27                  (ii)    for a student in full-day kindergarten through
28            grade eight, $5,000;
29                  (iii)    for a student in grades nine through twelve,
30            $10,000; or

 1                  (iv)   for a student with special needs regardless of
 2            grade level, $15,000.
 3            (3)   Beginning with the 2027-2028 school year, and each
 4      school year thereafter, the amounts in paragraph (2) shall be
 5      increased by the greater of the average percentage increase
 6      in the index as defined in section 302 of the act of June 27,
 7      2006 (1st Sp.Sess., P.L.1873, No.1), known as the Taxpayer
 8      Relief Act, for all school districts for the prior school
 9      year and the percentage increase in the appropriation for
10      basic education for the prior fiscal year. The State Treasury
11      shall calculate the increases on an annual basis and shall
12      submit a notice of the increases to the Legislative Reference
13      Bureau for publication in the next available issue of the
14      Pennsylvania Bulletin.
15      (c)   Installments.--The State Treasury shall deposit the
16   money for each scholarship into a lifeline scholarship account
17   on a schedule determined by the State Treasury in consultation
18   with the department.
19      (d)   Payments to participating nonpublic schools.--A parent
20   may direct payments from the lifeline scholarship account to a
21   participating nonpublic school on behalf of the scholarship
22   recipient via an electronic money transfer system or other
23   method approved by the State Treasury under section 1709-E.
24   Section 1707-E.       Qualified education expenses.
25      (a)   Authorized use.--Money deposited into a lifeline
26   scholarship account may be used only to pay for the following
27   qualified expenses incurred by or associated with the
28   scholarship recipient:
29            (1)   Tuition required by a participating nonpublic
30      school.

 1            (2)   School-related fees.
 2            (3)   Special education services fees.
 3      (b)   Prohibition.--A participating nonpublic school that
 4   receives a payment for qualified education expenses authorized
 5   under subsection (a) may not refund, rebate or otherwise
 6   directly share any portion of the payment with the parent who
 7   made the payment.
 8      (c)   Tax consequences and status of awards.--
 9            (1)   The money in a lifeline scholarship account is not
10      taxable income to the parent or scholarship recipient under
11      State law.
12            (2)   An award made to, or payment from, a lifeline
13      scholarship account may not be construed to be an
14      appropriation or financial assistance to a participating
15      nonpublic school.
16   Section 1708-E.    Lifeline Scholarship Fund.
17      (a)   Establishment.--The Lifeline Scholarship Fund is
18   established in the State Treasury. All interest and earnings
19   received from investment or deposit of the money in the fund
20   shall be paid into the fund and used for scholarships. Any
21   unexpended money and interest or earnings on the money in the
22   fund may not be transferred or revert to the General Fund but
23   shall remain in the fund.
24      (b)   Funding.--The fund shall consist of the following:
25            (1)   Money that is appropriated, given, granted or
26      donated by the Commonwealth or any other government or
27      private agency or person for the purpose established under
28      this article.
29            (2)   An amount equal to $350,000,000, which shall be
30      transferred from the General Fund to the fund no later than

 1      15 days after the effective date of this section and each
 2      August 1 thereafter.
 3      (c)   Continuing appropriation.--The money in the fund is
 4   appropriated on a continuing basis to the State Treasury for
 5   scholarships.
 6   Section 1709-E.    Duties of State Treasury.
 7      (a)   List of duties.--The State Treasury shall:
 8            (1)   Develop guidelines, in consultation with the
 9      department, as necessary for the administration of this
10      article.
11            (2)   Make payments to lifeline scholarship accounts as
12      provided in this article.
13            (3)   Develop a system that enables a parent to direct
14      payment to a participating nonpublic school in accordance
15      with this article.
16            (4)   Develop a process by which a nonpublic school may
17      inform the State Treasury of the nonpublic school's interest
18      to participate in the program and demonstrate compliance with
19      the requirements of this article.
20            (5)   Ensure that eligible students and their parents are
21      informed annually of the participating nonpublic schools in
22      the program by posting a list of participating nonpublic
23      schools on the State Treasury's publicly accessible Internet
24      website no later than April 1, 2026, and by April 1 of each
25      year thereafter.
26            (6)   At such time and in such form and manner as
27      determined by the State Treasury, request and receive
28      information and data from a public school, resident school
29      district, participating nonpublic school or applicant
30      determined to be necessary by the State Treasury to

 1      administer this article.
 2      (b)   Third-party administration.--The State Treasury may
 3   contract with a third party to administer the program.
 4      (c)   Contracting.--
 5            (1)   Notwithstanding any provision of 62 Pa.C.S. Pt. I
 6      (relating to Commonwealth Procurement Code) to the contrary
 7      and in order to facilitate the prompt implementation of this
 8      article, a contract may be awarded for a supply or service
 9      without competition if the State Treasury determines in
10      writing that the contract is necessary for the implementation
11      of any provision of this article and is in the best interest
12      of the Commonwealth. The State Treasury shall provide and
13      make publicly available a written justification of any
14      procurement under this section.
15            (2)   Paragraph (1) shall expire no later than two years
16      following the issuance of the procurement under paragraph
17      (1). Procurements issued after that period shall occur in
18      accordance with other applicable law.
19      (d)   Regulations.--
20            (1)   In order to facilitate the prompt implementation of
21      this article, regulations determined to be necessary and
22      promulgated by the State Treasury shall be deemed temporary
23      regulations and shall expire no later than two years
24      following the publication of temporary regulations. The State
25      Treasury may promulgate temporary regulations not subject to:
26                  (i)    Section 612 of the act of April 9, 1929
27            (P.L.177, No.175), known as The Administrative Code of
28            1929.
29                  (ii)    Sections 201, 202, 203, 204 and 205 of the act
30            of July 31, 1968 (P.L.769, No.240), referred to as the

 1            Commonwealth Documents Law.
 2                   (iii)    Section 204(b) of the act of October 15, 1980
 3            (P.L.950, No.164), known as the Commonwealth Attorneys
 4            Act.
 5                   (iv)    The act of June 25, 1982 (P.L.633, No.181),
 6            known as the Regulatory Review Act.
 7            (2)    The authority provided to the State Treasury to
 8      adopt temporary regulations under this subsection shall
 9      expire no later than two years following the publication of
10      the temporary regulations. Regulations adopted after that
11      period shall be promulgated as provided by law.
12   Section 1710-E.         Auditor General powers.
13      The Auditor General may:
14            (1)    Conduct a random audit of lifeline scholarship
15      accounts.
16            (2)    Refer cases of suspected fraudulent misuse of
17      lifeline scholarship accounts to the Inspector General for
18      investigation. If the investigation results in a finding that
19      rises to the level of criminal activity, the Inspector
20      General shall refer the matter to the appropriate law
21      enforcement agency for prosecution.
22            (3)    Notify the State Treasury of cases of suspected
23      fraudulent misuse that are referred to the Inspector General.
24   Section 1711-E.         Duties of participating nonpublic schools.
25      (a)   Notification requirement.--A nonpublic school that
26   desires to participate in the program shall notify the State
27   Treasury by a date and in a manner and form established by the
28   State Treasury. The notification shall include certification by
29   the nonpublic school that:
30            (1)    The nonpublic school is a nonprofit entity exempt

 1      from Federal taxation under 26 U.S.C. § 501(c)(3) (relating
 2      to exemption from tax on corporations, certain trusts, etc.).
 3            (2)   The nonpublic school complies with the
 4      nondiscrimination policies specified in 42 U.S.C. § 1981
 5      (relating to equal rights under the law).
 6            (3)   The nonpublic school complies with the provisions of
 7      sections 111 and 111.1.
 8      (b)   Prohibition.--A participating nonpublic school may not
 9   charge a lifeline scholarship recipient a tuition rate, student-
10   related fees or special education services fees that are higher
11   than the rates the participating nonpublic school would have
12   charged to a student who had not received a lifeline
13   scholarship.
14      (c)   Reporting requirements.--
15            (1)   A participating nonpublic school shall report in a
16      manner and form determined by the State Treasury, in
17      consultation with the department, information regarding
18      scholarship recipients enrolled in the participating
19      nonpublic school as follows:
20                  (i)    Enrollment and disenrollment.
21                  (ii)    Regular attendance.
22                  (iii)    Chronic absenteeism.
23                  (iv)    Academic progress as measured by advancement to
24            the next grade level.
25                  (v)    Indication of graduation.
26                  (vi)    Concurrent or dual enrollment course credits.
27            (2)   The State Treasury shall report the information
28      regularly to the department on a schedule agreed to by the
29      State Treasury and the department.
30      (d)   Construction.--

 1            (1)   For purposes of this article, a participating
 2      nonpublic school shall be autonomous and is not an agent of
 3      the State Treasury, the department or the Commonwealth.
 4            (2)   Neither the State Treasury, the department nor other
 5      State agency may regulate the educational program of a
 6      participating nonpublic school that accepts money from a
 7      scholarship recipient beyond what is necessary to administer
 8      the program.
 9   Section 1712-E.    Bar of certain participating nonpublic schools.
10      (a)     Authority to State Treasury.--The State Treasury may bar
11   a nonpublic school from participation in the program if the
12   State Treasury establishes that the nonpublic school has:
13            (1)   routinely failed to comply with the requirements
14      established in section 1711-E; or
15            (2)   failed to provide a scholarship recipient with the
16      educational services funded by the recipient's lifeline
17      scholarship account.
18      (b)     Notice.--If the State Treasury bars a nonpublic school
19   from participation in the program, the State Treasury shall,
20   after any appeal is concluded and the State Treasury's decision
21   is upheld under subsection (c), post the decision on the State
22   Treasury's publicly accessible Internet website.
23      (c)     Appeal.--A nonpublic school may appeal the State
24   Treasury's decision to bar its participation in the program
25   within 30 days of issuance of the decision. The appeal shall be
26   governed by 2 Pa.C.S. Chs. 1 (relating to general provisions), 5
27   (relating to practice and procedure) and 7 (relating to judicial
28   review).
29   Section 1713-E.    Duties of resident school districts.
30      A resident school district shall provide a participating

 1   nonpublic school that has admitted a scholarship recipient with
 2   a complete copy of the scholarship recipient's school record
 3   within 10 days of the receipt of notice from the participating
 4   nonpublic school of the scholarship recipient's enrollment.
 5   Section 1714-E.     Report.
 6      (a)   Duty to prepare and submit.--Beginning January 31, 2027,
 7   and each January 31 thereafter, the State Treasury, in
 8   consultation with the department, shall prepare and submit to
 9   the General Assembly an annual report on the program.
10      (b)   Contents.--The report shall include the following:
11            (1)    The total number of applications received for the
12      program.
13            (2)    The total number of applications received for the
14      program, by resident school district.
15            (3)    The total number of applications approved for the
16      program.
17            (4)    The total number of applications approved for the
18      program, by resident school district.
19            (5)    The total number of lifeline scholarship accounts
20      terminated early.
21            (6)    The total number of lifeline scholarship accounts
22      investigated for fraud by the Inspector General.
23            (7)    The total number of scholarships awarded to students
24      attending half-day kindergarten.
25            (8)    The total number of scholarships awarded to students
26      attending full-day kindergarten through grade eight.
27            (9)    The total number of scholarships awarded to students
28      attending grades nine through twelve.
29            (10)   The total dollar amount of scholarships awarded.
30            (11)   The total number of applications not approved due

1     to lack of funding.
2         (12)     The cost of administration of the program.
3         (13)     Other information the State Treasury deems helpful
4     to the General Assembly.
5     Section 2.    This act shall take effect immediately.
