AN ACT
1 Amending Titles 53 (Municipalities Generally), 66 (Public
2 Utilities) and 74 (Transportation) of the Pennsylvania
3 Consolidated Statutes, in transportation network companies,
4 providing for excise fee; in transportation network service,
5 providing for excise fee; and, in sustainable mobility
6 options, further providing for fund.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Title 53 of the Pennsylvania Consolidated
10 Statutes is amended by adding a section to read:
11 § 57A23. Excise fee.
12 (a) Imposition.--A transportation network company operating
13 within a city of the first class shall remit to the Public
14 Transportation Trust Fund a fee equal to 4.6% of the gross
15 receipts derived from all fares charged to all passengers for
16 prearranged rides that originate in the city.
17 (b) Remittance and deposit.--The fee required under
18 subsection (a) shall be remitted on a quarterly basis and
1 deposited into the Public Transportation Trust Fund.
2 Section 2. Title 66 is amended by adding a section to read:
3 § 2611. Excise fee.
4 (a) Imposition.--A transportation network company operating
5 outside a city of the first class shall remit to the Public
6 Transportation Trust Fund a fee equal to 6% of the gross
7 receipts derived from all fares charged to all passengers for
8 prearranged rides that originate outside a city of the first
9 class.
10 (b) Remittance and deposit.--The fee required under
11 subsection (a) shall be remitted on a quarterly basis and
12 deposited into the Public Transportation Trust Fund.
13 Section 3. Section 1506(c) of Title 74 is amended by adding
14 a paragraph and subsection (e)(1) is amended by adding a
15 subparagraph to read:
16 § 1506. Fund.

18 (c) Other deposits.--The following shall be deposited into
19 the fund annually:

21 (3.5) Revenues deposited into the fund in accordance
22 with 53 Pa.C.S. § 57A23 (relating to excise fee) and 66
23 Pa.C.S. § 2611 (relating to excise fee).

25 (e) Program funding amounts.--Subject to available funds,
26 the programs established under this chapter shall be funded
27 annually as follows:
28 (1) For the program established under section 1513
29 (relating to operating program), the following amounts shall
30 be allocated from the fund:

5 Section 4. This act shall take effect immediately.
