                                    AN ACT
 1   Amending Title 66 (Public Utilities) of the Pennsylvania
 2      Consolidated Statutes, in restructuring of electric utility
 3      industry, providing for membership in regional transmission
 4      organization.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7      Section 1.    Title 66 of the Pennsylvania Consolidated
 8   Statutes is amended by adding a section to read:
 9   § 2816.   Membership in regional transmission organization.
10      (a)    Membership.--An electric distribution company shall be a
11   member of a regional transmission organization.
12      (b)    Filing of report.--On or before February 1 each year, an
13   electric distribution company shall submit to the commission a
14   report on any recorded vote cast by the electric distribution
15   company or, subject to subsection (c), an affiliate of the
16   electric distribution company at a meeting of a regional
17   transmission organization during the immediately preceding
18   calendar year.
 1      (c)   Contents of report.--The report under subsection (b)
 2   shall include:
 3            (1)   All recorded votes cast by the electric distribution
 4      company, regardless of whether the vote is otherwise
 5      disclosed.
 6            (2)   All votes cast by an affiliate of the electric
 7      distribution company, if the electric distribution company
 8      itself did not vote on the matter.
 9            (3)   A brief description explaining how each vote cast by
10      the electric distribution company or its affiliate is in the
11      interest of the public. Each description shall be no less
12      than 20 words in length and no more than 100 words in length.
13      (d)   Definitions.--As used in this section, the following
14   words and phrases shall have the meanings given to them in this
15   subsection unless the context clearly indicates otherwise:
16      "Affiliate."    A corporation or person with an affiliated
17   interest as defined in section 2101 (relating to definition of
18   affiliated interest).
19      "Meeting."    A committee, user group, task force or other part
20   of a regional transmission organization in which votes are
21   taken.
22      "Recorded vote."     A vote that is tabulated, either
23   individually or as part of a sector, for any purpose at a
24   meeting, regardless of:
25            (1)   whether the vote represents a final position of any
26      person casting the vote; or
27            (2)   the decision-making authority of those voting.
28      "Regional transmission organization."     An entity that
29   qualifies as a regional transmission organization under 18 CFR
30   35.34 (relating to regional transmission organizations).
