                                      AN ACT
 1   Amending Titles 24 (Education) and 71 (State Government) of the
 2      Pennsylvania Consolidated Statutes, in membership,
 3      contributions and benefits, further providing for creditable
 4      nonschool service; and, in membership, credited service,
 5      classes of service, and eligibility for benefits, further
 6      providing for creditable nonstate service.
 7      The General Assembly of the Commonwealth of Pennsylvania
 8   hereby enacts as follows:
 9      Section 1.      Section 8304(b)(2) of Title 24 of the
10   Pennsylvania Consolidated Statutes is amended to read:
11   § 8304.    Creditable nonschool service.

13      (b)    Limitations on nonschool service.--Creditable nonschool
14   service credit shall be limited to:
15             * * *
16             (2)   Military service other than intervening military
17      service, activated military service or service performed
18      during USERRA leave not exceeding [five] ten years provided
19      that a member with multiple service may not purchase more
20      than a total of [five] ten years of military service in both
 1      the system and the State Employees' Retirement System.

 3      Section 2.      Section 5304(c)(2)(ii) of Title 71 is amended to
 4   read:
 5   § 5304.    Creditable nonstate service.
 6      * * *
 7      (c)    Limitations on nonstate service.--Creditable nonstate
 8   service credit shall be limited to:

10             (2)   * * *
11                   (ii)    the total creditable nonstate service under
12             this paragraph may not exceed [five] ten years, provided
13             that a member with multiple service may not purchase more
14             than a total of [five] ten years of military service in
15             both the system and the Public School Employees'
16             Retirement System;

18      Section 3.      This act shall take effect in 60 days.
