                                    AN ACT
 1   Amending the act of November 27, 2019 (P.L.667, No.92), entitled
 2      "An act abolishing numerous State authorities, boards,
 3      commissions, committees, councils and representatives; and
 4      making related repeals," further providing for State
 5      authorities, boards, commissions, committees, councils and
 6      representatives abolishment; providing for composition of
 7      Pennsylvania Human Relations Commission, for transfer of
 8      duties and for duty of Secretary of the Commonwealth relating
 9      to Interstate Rail Passenger Advisory Council Compact;
10      further providing for repeals; and abrogating an executive
11      order.
12      The General Assembly of the Commonwealth of Pennsylvania
13   hereby enacts as follows:
14      Section 1.    Section 1 of the act of November 27, 2019
15   (P.L.667, No.92), entitled "An act abolishing numerous State
16   authorities, boards, commissions, committees, councils and
17   representatives; and making related repeals," is amended to
18   read:
19   Section 1.   State authorities, boards, commissions, committees,
20                councils and representatives abolishment.
21      The following State authorities, boards, commissions,
 1   committees, councils and representatives, as established by law,
 2   are abolished:
 3          (1)   The Advisory Committee on Probation within the
 4      Pennsylvania Board of Probation and Parole.
 5          (1.1)     The Canine Health Board.
 6          (1.2)     The Climate Change Advisory Committee within the
 7      Department of Environmental Protection.
 8          (1.3)     The Coastal Zone Advisory Committee within the
 9      Department of Environmental Protection.
10          (1.4)     The Flood Insurance Premium Assistance Task Force.
11          (1.5)     The Greater Pennsylvania Council.
12          (1.6)     The High Speed Intercity Passenger Rail
13      Commission.
14          (2)   The Industrial Resource Center Strategic Advisory
15      Board within the Department of Community and Economic
16      Development.
17          (2.1)     The Interagency Coordinating Council.
18          (3)   The joint committee to review the cost-of-living
19      supplements under 24 Pa.C.S. § 8348 (relating to supplemental
20      annuities) and 71 Pa.C.S. § 5708 (relating to supplemental
21      annuities).
22          (3.1)     The Lobbying Disclosure Regulations Committee.
23          (3.2)     The Pennsylvania Civil Disorder Authority.
24          (3.3)     The Pennsylvania Dairy Future Commission.
25          (4)   The Pennsylvania Public Television Network
26      Commission.
27          (4.1)     The Prevailing Wage Advisory Board within the
28      Department of Labor and Industry.
29          (5)   The Public Television Broadcasting Advisory Council.
30          (6)   The Pennsylvania Quality Leadership Awards Council.

 1            (6.1)   The Recycling Fund Advisory Committee within the
 2      Department of Environmental Protection.
 3            (6.2)   The Senior Citizen Advisory Committee within the
 4      Pennsylvania Commission on Crime and Delinquency.
 5            (7)   The Small Business Advocacy Council within the
 6      Department of Community and Economic Development.
 7            (8)   The Tobacco Use Prevention and Cessation Advisory
 8      Committee within the Department of Health.
 9            (9)   The legislative representative for collective
10      bargaining appointed under 71 Pa.C.S. § 2205 (relating to
11      legislative representation for collective bargaining).
12      Section 2.     The act is amended by adding sections to read:
13   Section 1.1.     Pennsylvania Human Relations Commission.
14      (a)   Membership.--The Pennsylvania Human Relations Commission
15   established under section 6 of the act of October 27, 1955
16   (P.L.744, No.222), known as the Pennsylvania Human Relations
17   Act, shall consist of the following members:
18            (1)   Two individuals appointed by the President pro
19      tempore of the Senate.
20            (2)   Two individuals appointed by the Minority Leader of
21      the Senate.
22            (3)   Two individuals appointed by the Speaker of the
23      House of Representatives.
24            (4)   Two individuals appointed by the Minority Leader of
25      the House of Representatives.
26            (5)   One individual appointed by the Governor.
27            (6)   One individual appointed by the Attorney General of
28      the Commonwealth.
29            (7)   One individual appointed by the Auditor General of
30      the Commonwealth.

 1      (b)   Terms, vacancies and absences.--
 2            (1)   A member appointed under subsection (a) shall hold
 3      office for a term of five years or until the member's
 4      successor is duly appointed.
 5            (2)   Vacancies occurring in an office of a member of the
 6      commission by expiration of term, death, resignation, removal
 7      or for any other reason shall be filled in the manner
 8      provided in subsection (a) for the balance of the term.
 9            (3)   Commission members failing to attend meetings for
10      three consecutive months shall forfeit their seats unless the
11      chairperson receives written notification from the member
12      involved that the absence was due to personal illness or the
13      death or illness of an immediate family member.
14      (c)   Chairperson.--The members of the Pennsylvania Human
15   Relations Commission shall elect a member to serve as
16   chairperson of the Pennsylvania Human Relations Commission.
17   Section 1.2.    Transfer of duties.
18      The following duties are transferred:
19            (1)   The Secretary of Agriculture shall carry out the
20      duties of the former Canine Health Board under section 207(h)
21      (7) and (8) and (i)(3) and (5) of the act of December 7, 1982
22      (P.L.784, No.225), known as the Dog Law.
23            (2)   The Secretary of the Commonwealth shall carry out
24      the duties of the former Lobbying Disclosure Regulations
25      Committee under 65 Pa.C.S. § 13A10(d)(5) and (6) (relating to
26      registration fees; fund established; system; regulations).
27   Section 1.3.    Duty of Secretary of the Commonwealth.
28      Within 10 days of the effective date of this section, the
29   Secretary of the Commonwealth shall, pursuant to Article IV of
30   the Interstate Rail Passenger Advisory Council Compact, give

 1   notice to the other participating states of the repeal of the
 2   act of June 22, 1980 (P.L.259, No.75), entitled "An act adopting
 3   the interstate high speed intercity rail passenger network
 4   compact and for related purposes."
 5      Section 3.      Section 2 of the act is amended by adding
 6   paragraphs to read:
 7   Section 2.   Repeals.
 8      Repeals are as follows:
 9          * * *
10          (3)     The General Assembly declares that the repeals under
11      paragraph (4) are necessary to effectuate section 1(1.1) of
12      this act.
13          (4)     (i)   Section 221 of the act of December 7, 1982
14          (P.L.784, No.225), known as the Dog Law, is repealed.
15                (ii)     Section 207(h)(7) and (8) and (i)(3) and (5) of
16          the Dog Law are repealed to the extent of any
17          inconsistency with section 1(1.1) of this act.
18          (5)     The General Assembly declares that the repeals under
19      paragraph (6) are necessary to effectuate section 1(1.2) of
20      this act.
21          (6)     The following provisions of the act of July 9, 2008
22      (P.L.935, No.70), known as the Pennsylvania Climate Change
23      Act, are repealed:
24                (i)     The definition of "committee" in section 2 of
25          that act.
26                (ii)     The phrase "and the committee" in section 3(b)
27          of that act.
28                (iii)     The phrases "In consultation with the
29          committee," and "and the committee" in section 4(a) and
30          (c), respectively, of that act.

 1               (iv)    Section 5 of that act.
 2               (v)    The phrase ", in consultation with the
 3        committee," in section 7(a) and paragraph (4) of the
 4        subsection of that act.
 5        (7)     The General Assembly declares that the repeals under
 6    paragraph (8) are necessary to effectuate section 1(1.4) of
 7    this act.
 8        (8)     Article XV-C of the act of April 9, 1929 (P.L.177,
 9    No.175), known as The Administrative Code of 1929, is
10    repealed.
11        (9)     The General Assembly declares that the repeal under
12    paragraph (10) is necessary to effectuate section 1(1.5) of
13    this act.
14        (10)    The act of May 29, 1931 (P.L.278, No.131), entitled
15    "An act creating a "Greater Pennsylvania Council" for the
16    promotion of the economic, social, industrial, agricultural,
17    educational, civic and recreational welfare of the
18    Commonwealth of Pennsylvania and its citizens; prescribing
19    the organization, powers and duties of said council; and
20    making an appropriation," is repealed.
21        (11)    The General Assembly declares that the repeal under
22    paragraph (12) is necessary to effectuate section 1(1.6) of
23    this act.
24        (12)    The act of December 22, 1981 (P.L.518, No.144),
25    known as the High Speed Intercity Rail Passenger Commission
26    Act, is repealed.
27        (13)    The General Assembly declares that the repeal under
28    paragraph (14) is necessary to effectuate section 1(2.1) of
29    this act.
30        (14)    Section 6 of the act of October 22, 1986 (P.L.1452,

 1    No.143), known as the Pennsylvania Adult and Family Literacy
 2    Education Act, is repealed.
 3        (15)    The General Assembly declares that the repeal under
 4    paragraph (16) is necessary to effectuate section 1(3.1) of
 5    this act.
 6        (16)    65 Pa.C.S. § 13A10(d)(1), (2), (3) and (4)
 7    (relating to registration fees; fund established; system;
 8    regulations) are repealed.
 9        (17)    The General Assembly declares that the repeal under
10    paragraph (18) is necessary to effectuate section 1(3.2) of
11    this act.
12        (18)    Articles III and IV of the Act of July 31, 1968
13    (P.L.738, No.233), known as the Pennsylvania Fair Plan Act,
14    are repealed.
15        (19)    The General Assembly declares that the repeal under
16    paragraph (20) is necessary to effectuate section 1(3.3) of
17    this act.
18        (20)    3 Pa.C.S. Ch. 9 (relating to Pennsylvania Dairy
19    Future Commission) is repealed.
20        (21)    The General Assembly declares that the repeal under
21    paragraph (22) is necessary to effectuate section 1(4.1) of
22    this act.
23        (22)    The following provisions of the act of August 15,
24    1961 (P.L.987, No.442), known as the Pennsylvania Prevailing
25    Wage Act, are repealed:
26               (i)    Section 2(9) of that act.
27               (ii)    Section 2.1 of that act.
28               (iii)    So much of section 2.2(c) of that act that
29        states: "No member of the Advisory Board created by this
30        amendatory act shall be appointed to the Appeals Board."

 1                    (iv)   The phrase ", after consultation with the
 2             advisory board," in section 7 of that act.
 3             (23)    The General Assembly declares that the repeal under
 4      paragraph (24) is necessary to effectuate section 1(6.1) of
 5      this act.
 6             (24)    Section 706(e) of the act of July 28, 1988
 7      (P.L.556, No.101), known as the Municipal Waste Planning,
 8      Recycling and Waste Reduction Act, is repealed.
 9             (25)    The General Assembly declares that the repeal under
10      paragraph (26) is necessary to effectuate section 1(6.2) of
11      this act.
12             (26)    The act of December 21, 1998 (P.L.187, No.152),
13      known as the Senior Citizen Advisory Committee Act, is
14      repealed.
15             (27)    The General Assembly declares that the repeals
16      under paragraph (28) are necessary to effectuate section 1.1
17      of this act.
18             (28)    Section 6(b) and (d) of the act of October 27, 1955
19      (P.L.744, No.222), known as the Pennsylvania Human Relations
20      Act, are repealed.
21             (29)    The General Assembly declares that the repeal under
22      paragraph (30) is necessary to effectuate section 1.3 of this
23      act.
24             (30)    The act of June 22, 1980 (P.L.259, No.75), is
25      repealed.
26      Section 4.       The provisions of Executive Order 1980-20, 4 Pa.
27   Code Ch. 1 Subch. EE are abrogated to the extent of any
28   inconsistency with the addition of section 1(1.3) of the act.
29      Section 5.       This act shall take effect in 60 days.
