AN ACT
1 Amending the act of May 19, 1995 (P.L.33, No.3), entitled "An
2 act limiting environmental liability for economic development
3 agencies, financiers and fiduciaries," further providing for
4 definitions.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. The definition of "economic development agencies"
8 in section 3 of the act of May 19, 1995 (P.L.33, No.3), known as
9 the Economic Development Agency, Fiduciary and Lender
10 Environmental Liability Protection Act, is amended to read:
11 Section 3. Definitions.
12 The following words and phrases when used in this act shall
13 have the meanings given to them in this section unless the
14 context clearly indicates otherwise:

16 "Economic development [agencies."] agency." The term
17 includes:
18 (1) Any redevelopment authority created under the act of
1 May 24, 1945 (P.L.991, No.385), known as the Urban
2 Redevelopment Law, and any nonprofit corporation created and
3 controlled by a redevelopment authority to carry out its
4 statutory purpose.
5 (2) Any industrial development agency as that term is
6 defined in the act of May 17, 1956 (1955 P.L.1609, No.537),
7 known as the Pennsylvania Industrial Development Authority
8 Act.
9 (3) Any industrial and commercial development authority
10 created under the act of August 23, 1967 (P.L.251, No.102),
11 known as the Economic Development Financing Law.
12 (4) Any area loan organization as that term is defined
13 in [the act of July 2, 1984 (P.L.545, No.109), known as the
14 Capital Loan Fund Act] section 2301 of the act of June 29,
15 1996 (P.L.434, No.67), known as the Job Enhancement Act.
16 (5) Any other Commonwealth or municipal authority which
17 acquires title or an interest in property.
18 (6) [Municipalities] Any municipality or municipal
19 industrial development or community development [departments]
20 department organized by ordinance under a home rule charter
21 which [buy] buys and [sell] sells land for community
22 development purposes.
23 (7) [Tourist] Any tourist promotion [agencies] agency or
24 [their] its local community-based nonprofit sponsor which
25 [engage] engages in the acquisition of former industrial
26 sites as part of an "Industrial Heritage" or similar program.
27 (8) [Conservancies] Any conservancy engaged in the
28 renewal or reclamation of an industrial site.
29 (9) Any land bank established under 68 Pa.C.S. Ch. 21
30 (relating to land banks).
