AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," in disclosure of interscholastic
6 athletic opportunities, providing for annual evaluation.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10 as the Public School Code of 1949, is amended by adding a
11 section to read:
12 Section 1606-C. Annual evaluation.
13 (a) Compliance evaluation.--Not later than November 1 of
14 each year, a school entity shall perform an annual evaluation of
15 compliance with the regulations under 34 CFR 106.41 (relating to
16 athletics) and report to the department the findings of the
17 evaluation regarding the preceding school year or academic year.
18 A school entity shall publish a comprehensive report of the
19 evaluation on an annual basis and post the report on the
1 publicly accessible Internet website of the school entity.
2 (b) Duty of department.--The department shall:
3 (1) Develop a report card system, on an A-F letter
4 scale, to assess each school entity's performance under
5 subsection (a) and the provision of equal opportunities to
6 students of each race and gender based on the information
7 disclosed to the department under section 1604-C.
8 (2) Annually update a report card assessing the
9 performance of each school entity based on the system
10 developed under paragraph (1) and publish the report card on
11 the publicly accessible Internet website of the department.
12 (c) Requirements.--The report card developed under
13 subsection (b) shall:
14 (1) Be concise.
15 (2) Provide a letter grade based on equitable
16 participation and spending for each secondary sport offered
17 by a school entity.
18 (3) Be presented in an understandable and uniform format
19 and, to the extent practicable, in a language that a parent
20 or legal guardian can understand.
21 (d) Publication.--A school entity shall publish the report
22 card developed by the department under subsection (b) on the
23 publicly accessible Internet website of the department and
24 notify each parent or legal guardian of the report card's
25 assessment of the school entity's performance on an annual
26 basis.
27 Section 2. This act shall take effect in 60 days.
