                                         AN ACT
 1   Amending Title 51 (Military Affairs) of the Pennsylvania
 2      Consolidated Statutes, in Pennsylvania National Guard,
 3      establishing the TRICARE Premium Reimbursement Program.
 4      The General Assembly of the Commonwealth of Pennsylvania
 5   hereby enacts as follows:
 6      Section 1.         Title 51 of the Pennsylvania Consolidated
 7   Statutes is amended by adding a section to read:
 8   § 3106.    TRICARE Premium Reimbursement Program.
 9      (a)    Establishment and administration.--
10             (1)   The TRICARE Premium Reimbursement Program is
11      established within the department.
12             (2)   The department shall administer the program to
13      provide grants to each eligible recipient for costs paid by
14      the eligible recipient and associated with one or more of the
15      following:
16                   (i)    A premium paid for individual coverage through
17             the TRICARE Reserve Select program.
 1                  (ii)    A premium paid for any member of the immediate
 2            family of the eligible recipient covered under the
 3            TRICARE Reserve Select program.
 4                  (iii)   A premium paid for individual coverage under
 5            the TRICARE dental program.
 6                  (iv)    A premium paid for any member of the immediate
 7            family of the eligible recipient receiving dental
 8            benefits under the TRICARE dental program.
 9      (b)   Grants.--The department may award to an eligible
10   recipient grants of up to $60 for the reimbursement of the total
11   amount of premiums paid each month by the eligible recipient for
12   the coverages listed under subsection (a)(2).
13      (c)   Funding.--The department shall accept funding from the
14   following sources:
15            (1)   Money appropriated to the department to carry out
16      the purposes of this section.
17            (2)   Gifts or donations of money, securities or other
18      personal property, except real estate, to carry out the
19      purposes of this section. Interest and income generated by
20      the gifts or donations shall be used to carry out the
21      purposes of this section.
22      (d)   Guidelines and regulations.--The department shall
23   prescribe and adopt any policy guideline or regulation necessary
24   to implement, administer and enforce the program.
25      (e)   Definitions.--As used in this section, the following
26   words and phrases shall have the meanings given to them in this
27   subsection unless the context clearly indicates otherwise:
28      "Eligible recipient."       An individual who is:
29            (1)   eligible for TRICARE Reserve Select coverage; and
30            (2)   a member of the Pennsylvania National Guard.

 1      "Immediate family."   An individual specified in 10 U.S.C. §
 2   1072(2)(A), (D) or (I) (relating to definitions).
 3      "Program."   The TRICARE Premium Reimbursement Program
 4   established under subsection (a)(1).
 5      "TRICARE dental program."   The program established in 10
 6   U.S.C. § 1076a (relating to TRICARE dental program).
 7      "TRICARE Reserve Select."   As defined in 10 U.S.C. § 1076d(f)
 8   (2) (relating to TRICARE program: TRICARE Reserve Select
 9   coverage for members of the Selected Reserve).
10      "TRICARE Reserve Select program."   The program established in
11   10 U.S.C. § 1076d.
12      Section 2.   This act shall take effect in 180 days.
