AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, in general provisions relating to operation of
3 vehicles, providing for automated vehicle noise enforcement
4 systems; and imposing penalties.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Chapter 31 of Title 75 of the Pennsylvania
8 Consolidated Statutes is amended by adding a subchapter to read:

8 § 3131. Definitions.
9 The following words and phrases when used in this subchapter
10 shall have the meanings given to them in this section unless the
11 context clearly indicates otherwise:
12 "Automated vehicle noise enforcement system." A system using
13 one or more stationary cameras and decibel meters or similar
14 equipment to record images and establish meter readings to
15 enforce section 4523 (relating to exhaust systems, mufflers and
16 noise control) by determining whether a vehicle is in violation
17 of vehicle noise limits.
18 "Citation." A notice of a violation of vehicle noise limits
19 as a result of the use of an automated vehicle noise enforcement
20 system.
21 "Municipality." A county, city, borough, incorporated town
22 or township in this Commonwealth.
23 "System administrator." A person designated by a
24 municipality to administer the automated vehicle noise
25 enforcement system of the municipality.
26 "Vehicle noise limits." The limits specified in 67 Pa. Code
27 § 157.11 (relating to vehicular noise limits), in accordance
28 with 67 Pa. Code Ch. 157 (relating to established sound levels).
29 § 3132. Application process.
30 (a) Ordinance or resolution required.--A municipality may

1 enact an ordinance or resolution regulating vehicular noise
2 limits and authorizing the use of an automated vehicular noise
3 enforcement system, subject to the approval of the department in
4 accordance with this subchapter.
5 (b) Application.--
6 (1) Following the enactment of an ordinance or
7 resolution under subsection (a) and before the installation
8 and use of the automated vehicular noise enforcement system,
9 the municipality must apply to the department for approval of
10 the installation and use.
11 (2) The application under this subsection must be in the
12 form and manner as determined by the department and must
13 contain the following:
14 (i) A copy of the enacted ordinance or resolution.
15 (ii) Each designated intersection within the
16 municipality at which automated vehicle noise enforcement
17 system equipment is proposed to be located.
18 (iii) Any relevant circumstances meriting the
19 installation and use of the automated vehicle noise
20 enforcement system.
21 (iv) Any other information regarding the
22 municipality, including the size and population of the
23 municipality.
24 § 3133. Approval process.
25 (a) Review.--Within 60 days of receiving an application
26 under section 3132 (relating to application process), the
27 department shall review the application.
28 (b) Determination.--Following the review under subsection
29 (a), the department shall determine:
30 (1) Whether each proposed intersection is an appropriate

1 location for the location of the automated vehicle noise
2 enforcement system equipment.
3 (2) Whether a more appropriate intersection exists
4 within the municipality for the location of the automated
5 vehicle noise enforcement system equipment and, if so, the
6 identification of the more appropriate location.
7 (c) Additional considerations.--In making the determination
8 under subsection (b), the department may consider the factors
9 under section 3132(b)(2)(iii) and (iv).
10 (d) Notice.--The department shall provide written notice of
11 the determination under this section to the applicant, which
12 must include:
13 (1) The data on which the determination is based.
14 (2) If the application is denied, in whole or in part,
15 the reasons for the denial.
16 (e) Effect.--A municipality may not install or use automated
17 vehicle noise enforcement system equipment unless approved by
18 the department.
19 § 3134. System administrator.
20 (a) Designation.--As soon as practicable after approval by
21 the department of the installation and use of an automated
22 vehicle noise enforcement system in a municipality, the
23 municipality shall designate a system administrator for the
24 automated vehicle noise enforcement system.
25 (b) Duties.--A system administrator shall:
26 (1) Supervise the purchase, installation and management
27 of the automated vehicle noise enforcement system equipment.
28 (2) Hire or otherwise designate personnel and contract
29 with third parties as necessary to assist in the
30 implementation and management of the automated vehicle noise

1 enforcement system.
2 (3) Process notices of violations and fines incurred in
3 accordance with this subchapter and otherwise assist in the
4 enforcement of this subchapter.
5 (4) Serve as liaison between the municipality and the
6 department.
7 (5) Issue reports in accordance with subsection (c).
8 (6) Ensure that the compensation paid to the
9 manufacturer or vendor of the automated vehicle noise
10 enforcement system or to any contracted third party:
11 (i) Is not based upon the number of violation
12 notices issued or a portion or percentage of the fines
13 generated by the violation notices as a result of the use
14 of the automated vehicle noise enforcement system.
15 (ii) Is based upon the value of the automated
16 vehicle noise enforcement system equipment and the
17 services provided or rendered in support of the automated
18 noise enforcement system.
19 (c) Reports.--
20 (1) No later than March 30 of each year, each system
21 administrator shall issue a report to the secretary on the
22 automated vehicle noise enforcement system.
23 (2) Each report under this subsection must contain the
24 following information:
25 (i) The name and contact information of the
26 municipality and system administrator.
27 (ii) The class and size of the municipality.
28 (iii) The date of installation of automated vehicle
29 noise enforcement system equipment.
30 (iv) Each designated intersection at which

1 automated vehicle noise enforcement system equipment is
2 located.
3 (v) The average daily traffic at each designated
4 intersection, if known.
5 (vi) The number of violations that have occurred
6 during the immediately prior year at each designated
7 intersection.
8 (vii) The amount of fines incurred during the
9 immediately prior year at each designated intersection.
10 (viii) A summary of the number and amount of fines
11 that were collected during the immediately prior year.
12 (ix) A summary of the number and amount of fines
13 that were uncollected during the immediately prior year.
14 (x) The number and disposition of hearings and
15 appeals that have occurred during the immediately prior
16 year.
17 (xi) The amount of money paid to each vendor,
18 manufacturer or contracted third party associated with
19 the automated vehicle noise enforcement system during the
20 immediately prior year.
21 (xii) The costs associated with the installation and
22 use of the automated vehicle noise enforcement system
23 during the immediately prior year.
24 (xiii) The revenue limit in accordance with section
25 3137(h) (relating to fines).
26 (xiv) Any other information that the department
27 deems appropriate.
28 (3) Each report under this subsection shall be:
29 (i) Accessible for inspection and duplication in
30 accordance with the act of February 14, 2008 (P.L.6,

1 No.3), known as the Right-to-Know Law.
2 (ii) Posted on the publicly accessible Internet
3 website of the municipality.
4 § 3135. Implementation of automated vehicle noise enforcement
5 system.
6 (a) Public notice.--A municipality may not use an automated
7 vehicle noise enforcement system for a designated intersection
8 unless an appropriate sign is posted in a conspicuous place on
9 the approach to the designated intersection that notifies the
10 public of the existence of installed automated vehicle noise
11 enforcement system equipment at the designated intersection.
12 (b) Frontal view.--An automated vehicle noise enforcement
13 system may not be used in any manner that takes a recorded image
14 that is a frontal view of a vehicle as evidence of the
15 commission of a violation under this subchapter.
16 (c) Limitations on use.--Subject to subsection (d):
17 (1) Camera equipment deployed as part of an automated
18 vehicle noise enforcement system must be incapable of
19 automated or user-controlled remote intersection surveillance
20 by means of recorded video images.
21 (2) Recorded images collected as part of an automated
22 vehicle noise enforcement system may only record traffic
23 violations and may not be used for any other surveillance
24 purposes.
25 (3) If a municipality or an authorized agent or employee
26 of a municipality maintains information prepared under this
27 subchapter or information relating to violations under this
28 subchapter, including recorded images, written records,
29 reports or facsimiles, names and addresses, the information:
30 (i) Shall be for the exclusive use of the

1 municipality, authorized agent or employee of the
2 municipality and appropriate law enforcement officials
3 for the purpose of discharging duties in accordance with
4 this subchapter and any ordinance or resolution of the
5 municipality.
6 (ii) Shall be exempt from access under the act of
7 February 14, 2008 (P.L.6, No.3), known as the Right-to-
8 Know Law.
9 (iii) Shall not be discoverable by court order or
10 otherwise, or offered in evidence, in an action or
11 proceeding that is not directly related to a violation of
12 this subchapter or any ordinance or resolution of the
13 municipality.
14 (d) Construction.--The restrictions specified under
15 subsection (c) shall not be construed to preclude a court of
16 competent jurisdiction from issuing an order directing that the
17 information be provided to law enforcement officials if the
18 information is reasonably described and is requested solely in
19 connection with a criminal law enforcement action.
20 (e) Destruction of recorded images.--Within 30 days
21 following the final disposition of a case involving a recorded
22 event through the use of an automated vehicle noise enforcement
23 system by a municipality, the municipality shall:
24 (1) Destroy the associated recorded images.
25 (2) File notice with the Department of State that the
26 recorded images have been destroyed in accordance with this
27 subsection.
28 (f) Obtained information.--Information obtained through an
29 automated vehicle noise enforcement system regarding a
30 registered vehicle owner:

1 (1) Shall not be deemed the property of the manufacturer
2 or vendor of the automated vehicle noise enforcement system.
3 (2) May only be used in accordance with this subchapter.
4 § 3136. Citations.
5 (a) Issuance.--In enforcing vehicle noise limits through the
6 use of an automated vehicle noise enforcement system in a
7 municipality, the system administrator of the municipality shall
8 prepare a citation, which shall be issued only by a law
9 enforcement officer employed by the law enforcement agency
10 operated by the municipality, to the registered owner of the
11 vehicle identified in a recorded image produced by the automated
12 vehicle noise enforcement system as evidence of a violation
13 under this subchapter.
14 (b) Contents.--Each citation must contain or have attached
15 to it:
16 (1) A copy of the recorded image from the automated
17 vehicle noise enforcement system showing the vehicle.
18 (2) The registration number of the vehicle and state of
19 issuance of the vehicle registration.
20 (3) The date, time and place of the alleged violation.
21 (4) Notice that the citation is for an alleged violation
22 of vehicle noise limits under this subchapter.
23 (5) Instructions for how to complete and return the
24 citation.
25 (6) The following notice in substantially the following
26 form:
27 This citation is directed to you as the registered
28 owner of the vehicle that is alleged to be in
29 violation of vehicle noise limits. This citation must
30 be returned, in person or by mail, within 30 days of

1 issuance, along with the payment of the specified
2 fine or the completion of the section requesting a
3 hearing to contest liability.
4 (7) A certificate, or a facsimile of a certificate,
5 based upon inspection of recorded images produced by the
6 automated vehicle noise enforcement system and sworn to or
7 affirmed by a law enforcement officer employed by the law
8 enforcement agency operated by the municipality, that also
9 includes a statement that the automated vehicle noise
10 enforcement system was operating correctly at the time of the
11 alleged violation.
12 (c) Notice.--
13 (1) In the case of a citation involving a vehicle
14 registered in this Commonwealth, the citation must be sent,
15 by first class mail within 30 days after the occurrence of
16 the alleged violation or within 30 days after the discovery
17 of the identity of the registered owner of the vehicle,
18 whichever is later, to the address of the registered owner as
19 listed in the records of the department.
20 (2) In the case of a citation involving a vehicle
21 registered in a jurisdiction other than this Commonwealth,
22 the citation must be sent, by first class mail within 30 days
23 after the discovery of the identity of the registered owner
24 of the vehicle, to the address of the registered owner as
25 listed in the records of the other jurisdiction.
26 § 3137. Fines.
27 (a) Authorization.--A fine is not authorized under this
28 subsection during any of the following:
29 (1) The first 60 days of operation of the automated
30 vehicle noise enforcement system at the initial designated

1 intersection.
2 (2) The first 30 days of operation of the automated
3 vehicle noise enforcement system at each additional
4 designated intersection following the operation at the
5 initial designated intersection.
6 (b) Warning.--A warning may be issued to a person violating
7 this subchapter during any of the periods specified under
8 subsection (a).
9 (c) Owner liability.--The owner of the vehicle that is the
10 subject of a citation shall be liable for the penalty imposed
11 under this section unless the owner is convicted of the same
12 violation under another section of this title or has a defense
13 under section 3138 (relating to defenses).
14 (d) Amount.--A person violating this subchapter shall be
15 subject to a fine of $100 for each violation, unless a lesser
16 amount is set by the ordinance of the municipality in which the
17 violation occurred.
18 (e) Effect.--A fine imposed on an individual under this
19 section shall not:
20 (1) Be deemed a criminal conviction for the individual.
21 (2) Be made part of the individual's operating record
22 under section 1535 (relating to schedule of convictions and
23 points).
24 (3) Subject the individual to an adjustment in merit
25 rating for the insurance purposes.
26 (4) Subject the individual to the imposition of
27 surcharge points in the provision of motor vehicle insurance
28 coverage.
29 (f) Portion.--Fines collected under this section shall not
30 be subject to 42 Pa.C.S. § 3571 (relating to Commonwealth

1 portion of fines, etc.) or 3573 (relating to municipal
2 corporation portion of fines, etc.).
3 (g) Payment.--The owner of the vehicle to whom a citation
4 has been issued may admit responsibility for the violation and,
5 if so, shall pay the fine provided in the citation. The
6 following apply:
7 (1) Payment may be made to the municipality in person,
8 electronically or by mail, as directed in the citation.
9 (2) The citation must be returned to the municipality at
10 the time that payment is remitted or as soon as practicable
11 thereafter.
12 (3) Payment by mail may only be made by money order,
13 credit card or check made payable to the municipality.
14 (4) Payment shall operate as a final disposition of the
15 case.
16 (h) Revenue limit.--A municipality may not collect an amount
17 equal to or greater than 5% of its annual budget from the
18 collection of revenue from the issuance of citations and payment
19 of fines under this subchapter.
20 § 3138. Defenses.
21 The following are defenses to a violation under this section:
22 (1) The registered owner of the vehicle named in the
23 citation was not operating the vehicle at the time of the
24 violation. The following apply:
25 (i) The municipality may require the owner to submit
26 evidence that the owner was not the driver at the time of
27 the violation.
28 (ii) The municipality may not require the owner to
29 disclose the identity of the operator of the vehicle at
30 the time of the violation.

1 (2) The vehicle that is the subject of the citation was
2 reported to a law enforcement agency as stolen, and was not
3 recovered, prior to the time of the violation.
4 (3) The person who received the citation was not the
5 owner or lessor of the vehicle at the time of the violation.
6 § 3139. Hearings.
7 (a) Right to hearing.--A registered owner to whom a citation
8 is issued may, within 30 days of the issuance of the citation,
9 contest liability and request a hearing by completing the
10 appropriate section of the citation and returning the citation
11 to the municipality as directed.
12 (b) Duty of system administrator.--Upon receipt of a hearing
13 request, the system administrator shall:
14 (1) In a timely manner, schedule the matter before a
15 hearing officer designated by the municipality.
16 (2) Provide written notice of the date, time and place
17 of the hearing by first class mail to the person requesting
18 the hearing.
19 (c) Process.--The following apply to a hearing under this
20 section:
21 (1) The hearing shall be informal.
22 (2) The rules of evidence shall not apply during the
23 hearing.
24 (3) The decision of the hearing officer shall be final,
25 subject to appeal to the appropriate magisterial district
26 judge.
27 (4) If a person requests in writing that the decision of
28 the hearing officer be appealed, the system administrator
29 shall file the citation and supporting documents with the
30 appropriate magisterial district judge who shall hear and

1 decide the matter de novo.
2 § 3140. Evidence.
3 (a) Certificate.--The certificate or facsimile of the
4 certificate under section 3136(b)(7) (relating to citations)
5 shall be prima facie evidence of the facts contained in the
6 certificate or facsimile of the certificate.
7 (b) Mailing.--A manual or automatic record of mailing in
8 accordance with section 3136(c), which is prepared by the system
9 administrator in the ordinary course of business, shall be prima
10 facie evidence of mailing under section 3136(c) and shall be
11 admissible in any judicial or administrative proceeding as to
12 the facts contained in the mailed citation.
13 (c) Recorded image.--A recorded image evidencing a violation
14 under this subchapter shall be admissible in any judicial or
15 administrative proceeding to adjudicate the liability for the
16 violation.
17 § 3141. Reports by department.
18 (a) Issuance and contents.--No later than June 30 of each
19 year, the department shall issue a report on automated vehicle
20 noise enforcement systems in this Commonwealth which contains:
21 (1) A summary of the information contained in the
22 reports submitted in accordance with section 3134(c)
23 (relating to system administrator).
24 (2) An evaluation of the automated vehicle noise
25 enforcement system within each municipality that is using the
26 automated vehicle noise enforcement system, based on the
27 information contained in the reports submitted in accordance
28 with section 3134(c).
29 (3) Any recommendations regarding automated vehicle
30 noise enforcement systems and this subchapter.

1 (b) Submittal.--Each report under subsection (a) shall be
2 submitted to:
3 (1) The Governor.
4 (2) The chairperson and minority chairperson of the
5 Transportation Committee of the Senate.
6 (3) The chairperson and minority chairperson of the
7 Transportation Committee of the House of Representatives.
8 (c) Public notice.--Each report under subsection (a) shall
9 be:
10 (1) Accessible for inspection and duplication in
11 accordance with the act of February 14, 2008 (P.L.6, No.3),
12 known as the Right-to-Know Law.
13 (2) Posted on the publicly accessible Internet website
14 of the department.
15 § 3142. Rules and regulations.
16 The department may adopt or promulgate any rule or regulation
17 necessary to implement, administer and enforce this subchapter,
18 including:
19 (1) The form to apply for the installation and use of an
20 automated vehicle noise enforcement system.
21 (2) The appropriate signage and location of the signage
22 that notifies the public of the existence of installed
23 automated vehicle noise enforcement system equipment at a
24 designated intersection.
25 (3) Testing procedures and standards to determine
26 whether automated vehicle noise enforcement system equipment
27 is operating correctly.
28 (4) Forms for citations, certificates or facsimiles of
29 certificates, notices and other documentation under this
30 subchapter.

1 § 3143. Expiration.
2 This subchapter shall expire five years after the effective
3 date of this section.
4 Section 2. This act shall take effect in 60 days.
