                                    AN ACT
 1   Amending the act of December 19, 1990 (P.L.1200, No.202),
 2      entitled "An act providing for the registration and
 3      regulation of solicitations by charitable organizations,
 4      professional fundraisers and other solicitors; imposing
 5      additional powers on the Department of State and the Office
 6      of Attorney General; prescribing civil and criminal
 7      penalties; and making a repeal," further providing for
 8      definitions.
 9      The General Assembly of the Commonwealth of Pennsylvania
10   hereby enacts as follows:
11      Section 1.    The definition of "contribution" in section 3 of
12   the act of December 19, 1990 (P.L.1200, No.202), known as the
13   Solicitation of Funds for Charitable Purposes Act, is amended to
14   read:
15   Section 3.   Definitions.
16      The following words and phrases when used in this act shall
17   have the meanings given to them in this section unless the
18   context clearly indicates otherwise:

20      "Contribution."    The promise, grant or pledge of money,
21   credit, property[,] or financial assistance [or other thing of
 1   any kind or value, excluding volunteer services,] in response to
 2   a solicitation, including the payment or promise to pay in
 3   consideration of a performance, event or sale of a good or
 4   service. Payment by members of an organization for membership
 5   fees, dues, fines or assessments or for services rendered to
 6   individual members, if such fees, dues, fines or assessments
 7   confer a bona fide right, privilege, professional standing,
 8   honor or other direct benefit, shall not be deemed
 9   contributions, provided that membership is not conferred solely
10   as consideration for making a contribution in response to a
11   solicitation. Government grants or contracts shall not be deemed
12   a contribution.

14      Section 2.     This act shall take effect in 60 days.
