                                         AN ACT
 1   Amending Title 18 (Crimes and Offenses) of the Pennsylvania
 2      Consolidated Statutes, in sexual offenses, further providing
 3      for the offense of indecent exposure.
 4      The General Assembly of the Commonwealth of Pennsylvania
 5   hereby enacts as follows:
 6      Section 1.         Section 3127(b) of Title 18 of the Pennsylvania
 7   Consolidated Statutes is amended to read:
 8   § 3127.    Indecent exposure.
 9      * * *
10      (b)    Grading.--[If]
11             (1)   Except as otherwise provided in paragraph (2), if
12      the person knows or should have known that any of the persons
13      present are less than 16 years of age, indecent exposure
14      under subsection (a) is:
15                   (i)    For a first offense, a misdemeanor of the first
16             degree. [Otherwise, indecent exposure under subsection
17             (a) is a misdemeanor of the second degree.]
18                   (ii)    For a second or subsequent offense, a felony of
19             the third degree.
1         (2)   Indecent exposure under subsection (a) is:
2               (i)    For a first offense, a misdemeanor of the second
3         degree.
4               (ii)    For a second offense, a misdemeanor of the
5         first degree.
6               (iii)    For a third or subsequent offense, a felony of
7         the third degree.
8     Section 2.      This act shall take effect in 60 days.
