AN ACT
1 Amending the act of September 30, 1983 (P.L.160, No.39),
2 entitled "An act establishing salaries and compensation of
3 certain public officials including justices and judges of
4 Statewide courts, judges of courts of common pleas, judges of
5 the Philadelphia Municipal Court, judges of the Philadelphia
6 Traffic Court, district justices and the Governor, the
7 Lieutenant Governor, the State Treasurer, the Auditor
8 General, the Attorney General and certain other State
9 officers and the salary and certain expenses of the members
10 of the General Assembly; and repealing certain inconsistent
11 acts," further providing for judicial salaries, for
12 compensation of Governor and Lieutenant Governor, State
13 Treasurer, Auditor General, Attorney General, Commissioners
14 of the Pennsylvania Public Utility Commission and heads of
15 departments and for members of the General Assembly.
16 The General Assembly of the Commonwealth of Pennsylvania
17 hereby enacts as follows:
18 Section 1. Section 2.1(i)(1) of the act of September 30,
19 1983 (P.L.160, No.39), known as the Public Official Compensation
20 Law, is amended and the subsection is amended by adding a
21 paragraph to read:
22 Section 2.1. Judicial salaries.

24 (i) Annual cost-of-living adjustment.--
1 (1) Except as provided under paragraph (2), beginning
2 January 1, 1997, and each January 1 thereafter until January
3 1, 2026, the annual salaries under subsections (a) through
4 (h) shall be increased by the percentage change in the
5 Consumer Price Index for All Urban Consumers (CPI-U) for the
6 Pennsylvania, New Jersey, Delaware and Maryland area for the
7 most recent 12-month period for which figures have been
8 officially reported by the United States Department of Labor,
9 Bureau of Labor Statistics immediately prior to the date the
10 adjustment is due to take effect. The percentage increase and
11 salary amounts shall be determined prior to the annual
12 effective date of the adjustment by the Supreme Court and
13 shall be published in the Pennsylvania Bulletin by the Court
14 Administrator of Pennsylvania within 20 days of the date the
15 determination is made.

17 (4) The annual salaries for individuals subject to 42
18 Pa.C.S. § 1741(a)(1) or (2) (relating to compensation of
19 judges) may not be increased by an annual cost-of-living
20 adjustment under 42 Pa.C.S. § 1741(b) after January 1, 2026.
21 Section 2. Sections 3(e)(1) and 4(d)(1) and (d.1)(1) of the
22 act are amended to read:
23 Section 3. Compensation of Governor and Lieutenant Governor;
24 State Treasurer; Auditor General; Attorney General;
25 Commissioners of the Pennsylvania Public Utility
26 Commission; and heads of departments.

28 (e) Annual cost-of-living adjustment.--
29 (1) Except as provided under paragraph (2), beginning
30 January 1, 1997, and each January 1 thereafter until January

1 1, 2026, the stated annual salaries of the Governor and
2 Lieutenant Governor, the State Treasurer, the Auditor
3 General, the Attorney General and the heads of the
4 departments and members of boards and commissions denoted
5 herein shall be increased by an annual cost-of-living
6 increase calculated by applying the percentage change in the
7 Consumer Price Index for All Urban Consumers (CPI-U) for the
8 Pennsylvania, New Jersey, Delaware and Maryland area, for the
9 most recent 12-month period for which figures have been
10 officially reported by the United States Department of Labor,
11 Bureau of Labor Statistics immediately prior to the date the
12 adjustment is due to take effect, to the then current salary
13 amounts authorized. The percentage increase and the salary
14 amounts shall be determined by the Governor prior to the
15 annual effective date of the adjustment and shall be
16 published by the Secretary of the Budget in the Pennsylvania
17 Bulletin within ten days of the date the determination is
18 made.

22 (d) Subsequent annual cost-of-living adjustment for
23 members.--
24 (1) Except as provided under paragraph (2), for the 12-
25 month period beginning December 1, 1997, through November 30,
26 1998, and for each like 12-month period thereafter until
27 November 30, 2025, the salary of the members of the General
28 Assembly shall be increased by an annual cost-of-living
29 adjustment calculated by applying the percentage change in
30 the Consumer Price Index for All Urban Consumers (CPI-U) for

1 the Pennsylvania, New Jersey, Delaware and Maryland area, for
2 the most recent 12-month period for which figures have been
3 officially reported by the United States Department of Labor,
4 Bureau of Labor Statistics immediately prior to the date the
5 adjustment is due to take effect, to the then current salary
6 amounts. The percentage increase and the new salary amounts
7 shall be determined jointly by the Chief Clerk of the Senate
8 and the Chief Clerk of the House of Representatives prior to
9 the annual effective date of the adjustment and shall be
10 published by them in the Pennsylvania Bulletin within ten
11 days of the date such determination is made.

13 (d.1) Subsequent annual cost-of-living adjustment for
14 officers and leaders.--
15 (1) Except as provided under paragraph (2), for the 12-
16 month period beginning December 1, 1997, through November 30,
17 1998, and for each like 12-month period thereafter until
18 November 30, 2025, the additional compensation of the
19 officers and leaders of the General Assembly shall be
20 increased by an annual cost-of-living adjustment calculated
21 by applying the percentage change in the Consumer Price Index
22 for All Urban Consumers (CPI-U) for the Pennsylvania, New
23 Jersey, Delaware and Maryland area, for the most recent 12-
24 month period for which figures have been officially reported
25 by the United States Department of Labor, Bureau of Labor
26 Statistics immediately prior to the date the adjustment is
27 due to take effect, to the then current compensation. The
28 percentage increase and the new compensation amounts shall be
29 determined jointly by the Chief Clerk of the Senate and the
30 Chief Clerk of the House of Representatives prior to the

1 annual effective date of the adjustment and shall be
2 published in the Pennsylvania Bulletin within 20 days
3 immediately prior to each cost-of-living increase taking
4 effect.
