AN ACT
1 Amending the act of December 4, 1996 (P.L.911, No.147), entitled
2 "An act providing for registration requirements for
3 telemarketers and for powers and duties of the Office of
4 Attorney General," further providing for definitions, for
5 unlawful acts and penalties and for violations; and imposing
6 penalties.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 2 of the act of December 4, 1996
10 (P.L.911, No.147), known as the Telemarketer Registration Act,
11 is amended by adding definitions to read:
12 Section 2. Definitions.
13 The following words and phrases when used in this act shall
14 have the meanings given to them in this section unless the
15 context clearly indicates otherwise:
16 "Artificial intelligence." As follows:
17 (1) A machine-based system that can, for a given set of
18 human-defined objectives, make predictions, recommendations
19 or decisions influencing real or virtual environments,
1 including the ability to:
2 (i) perceive real and virtual environments;
3 (ii) abstract perceptions made under subparagraph
4 (i) into models through analysis in an automated manner;
5 and
6 (iii) use model inference to formulate options for
7 information or action based on outcomes under
8 subparagraphs (i) and (ii).
9 (2) The term includes generative artificial
10 intelligence.

12 "Generative artificial intelligence." The class of models
13 that emulate the structure and characteristics of input data in
14 order to generate derived synthetic content.

16 "Synthetic content." Information, including images, videos,
17 audio clips and text, that has been significantly modified or
18 generated by algorithms, including by artificial intelligence.

20 Section 2. Section 5(a) of the act is amended by adding a
21 paragraph to read:
22 Section 5. Unlawful acts and penalties.
23 (a) Acts enumerated.--The following acts are prohibited:

25 (11) Using artificial intelligence to:
26 (i) Make a telemarketing solicitation call.
27 (ii) Mimic the voice of a human on a telemarketing
28 solicitation call.
29 (iii) Select telephone numbers for telemarketing
30 purposes.

1 (iv) Change a telephone number to disguise the
2 origin of a telemarketing solicitation call.
3 (v) Otherwise interact with a consumer during a
4 telemarketing solicitation call.

6 Section 3. Section 6 of the act is amended by adding a
7 subsection to read:
8 Section 6. Violations.

10 (d) Violations relating to use of artificial intelligence.--
11 (1) In addition to any other penalty available under
12 this section or other law, a person that violates section
13 5(a)(11) shall be subject to a civil penalty not to exceed:
14 (i) $25,000 for a first violation.
15 (ii) $50,000 for a second violation.
16 (iii) $100,000 for a third or subsequent violation.
17 (2) An individual who has received a telemarketing
18 solicitation call in violation of section 5(a)(11) may bring
19 a private right of action in a court of common pleas in
20 accordance with the Pennsylvania Rules of Civil Procedure.
21 Section 4. This act shall take effect in 60 days.
