AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," in charter schools, further providing
6 for powers of board of trustees.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 1716-A(b) and (b.1) of the act of March
10 10, 1949 (P.L.30, No.14), known as the Public School Code of
11 1949, amended July 11, 2024 (P.L.618, No.55), are amended and
12 the section is amended by adding a subsection to read:
13 Section 1716-A. Powers of Board of Trustees.--* * *
14 (b) [A] Except as provided for under subsection (b.4), a
15 member of a local board of school directors of a school entity
16 may not serve on the board of trustees of a charter school
17 entity that is located in the member's district.
18 (b.1) [For] Except as provided for under subsection (b.4),
19 for a charter school or regional charter school chartered after
1 the effective date of this subsection, an individual may not
2 serve as a voting member of the board of trustees of the charter
3 school or regional charter school if the individual or a family
4 member receives compensation from or is employed by or is a
5 member of the local board of school directors who participated
6 in the initial review, approval, oversight, evaluation or
7 renewal process of the charter school or regional charter school
8 chartered by the board.

10 (b.4) The board of trustees of a charter school shall
11 include a member appointed by the local board of school
12 directors. In the case of a regional charter school, each board
13 of school directors for the chartering school districts shall
14 appoint a member.

16 Section 2. This act shall take effect immediately.
