AN ACT
1 Amending Title 66 (Public Utilities) of the Pennsylvania
2 Consolidated Statutes, in service and facilities, providing
3 for master-meter system and submetering program for landlord
4 ratepayers; and establishing programs.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Chapter 15 of Title 66 of the Pennsylvania
8 Consolidated Statutes is amended by adding a subchapter to read:
9 SUBCHAPTER C

11 FOR LANDLORD RATEPAYERS

17 § 1551. Declaration of policy.
18 The General Assembly finds and declares that it is the policy
1 of the Commonwealth to encourage access for tenants and landlord
2 ratepayers to energy technologies and efficiency through
3 programs which offer master-meter systems and submetering
4 options.
5 § 1552. Definitions.
6 The following words and phrases when used in this subchapter
7 shall have the meanings given to them in this section unless the
8 context clearly indicates otherwise:
9 "Conversion." The process of converting a residential
10 building from the use of a multimeter system to a master-meter
11 system.
12 "Energy efficiency." A reduction in overall consumption,
13 measured in kilowatt hours, or the shifting of an amount of
14 energy during a specified period of time, measured as demand in
15 kilowatts.
16 "Master-meter system." A system by which public utility and
17 electric generation services for a single residential building
18 or complex of buildings are billed through a commercial public
19 utility account. The term does not include a multimeter system.
20 "Multimeter system." A system by which each tenant holds an
21 individual public utility account. The term does not include a
22 master-meter system.
23 "Residential building." A building or complex of buildings
24 containing one or more dwelling units occupied by one or more
25 tenants. The term does not include nursing homes, hotels and
26 motels or any dwelling of which the landlord ratepayer is the
27 only resident, but does include mixed-use buildings containing
28 both residential dwelling units and units designated for
29 commercial use.
30 "Submetering." The process by which a landlord ratepayer

1 that receives energy through a master-meter system installs
2 meters owned by the landlord ratepayer and bills individual
3 tenants for their metered usage.
4 "Tenant." Any person or group of persons who are
5 contractually obligated to make rental payments to the landlord
6 ratepayer pursuant to a rental arrangement, including, but not
7 limited to, an oral or written lease with the landlord ratepayer
8 for a dwelling unit in a residential building or mobile home
9 park which is provided gas, electric, steam, sewer or water as
10 an included service under the rental agreement and who are not
11 the ratepayers of the utility which supplied the gas, electric,
12 steam, sewer or water service.
13 § 1553. Master-meter system and submetering program.
14 (a) Establishment.--The commission shall establish a program
15 for a landlord ratepayer or the landlord ratepayer's designated
16 agent for the use of a master-meter system or submetering.
17 (b) Criteria.--The commission shall ensure that the program
18 established under subsection (a) complies with the following
19 criteria:
20 (1) Allows a landlord ratepayer an option to choose a
21 master-meter service from a public utility for the landlord
22 ratepayer's residential property in accordance with section
23 1313 (relating to price upon resale of public utility
24 services).
25 (2) Ensures that a master-meter system has certified and
26 tested submeters for tenant bill accuracy.
27 (3) Requires a landlord ratepayer that bills tenants for
28 electric service to satisfy the requirements of section 1554
29 (relating to tenant benefits).
30 (4) Verifies a lease agreement prior to a conversion.

1 (5) Includes applicable requirements for disconnection,
2 including notice and payment plan requirements.
3 (6) Mandates registration for a designated agent used by
4 a landlord ratepayer for billing.
5 (7) Has standards for the purchase or lease of equipment
6 for contracts between a landlord ratepayer and a public
7 utility.
8 § 1554. Tenant benefits.
9 (a) Program established.--The commission shall establish a
10 program that enables a property owner to utilize the property
11 owner's business operation to participate in energy programs
12 that deliver benefits to tenants through the use of master-
13 metered service with submetering. The program shall provide
14 benefits under the total bill cap as established under section
15 1313 (relating to price upon resale of public utility services).
16 (b) Operation under master-metered system with
17 submetering.--A landlord may operate under a master-metered
18 system with submetering, provided that the landlord complies
19 with the mandatory tenant protections and program requirements
20 established under this section.
21 (c) Tenant energy control and savings.--
22 (1) A landlord shall satisfy at least one of the
23 following:
24 (i) Make available to each tenant or install in each
25 tenant's unit at least one technology option that enables
26 or assists the tenant's management of energy usage or
27 which beneficially manages a tenant's energy usage. The
28 options may include, but are not limited to:
29 (A) the ability to shift energy consumption to
30 different times of day;

1 (B) tools or technologies that enable an overall
2 reduction in energy usage or demand reduction for
3 grid or peak reduction support; and
4 (C) usage reduction technologies that provide
5 predictive maintenance capabilities and actionable
6 insights to identify water leaks, heating and air
7 conditioning system deficiencies or other in-unit
8 appliance or equipment concerns where the absence of
9 predictive maintenance or insights may otherwise
10 result in higher tenant utility bills due to
11 equipment malfunction or failure.
12 (ii) Guarantee that a tenant shall pay less for the
13 tenant's electric usage than the maximum amount permitted
14 under section 1313.
15 (2) A public utility may include verified demand
16 reduction or energy efficiency achieved through a master-
17 metered system as a qualifying reduction for the purposes of
18 shared savings or lost distribution revenue programs, as
19 determined by the commission.
20 (d) Baseline and efficiency reporting.--If data is available
21 to the landlord, the landlord or an authorized representative
22 shall submit to the commission a report documenting baseline
23 energy usage and postimplementation efficiency improvements
24 achieved under subsection (c). The reporting shall contribute
25 toward applicable utility program mandates as determined by the
26 commission.
27 (e) Itemized utility billing.--If a lease agreement permits
28 a landlord to charge a tenant for utility services, including
29 water, sewer, gas, electricity, trash removal, Internet or any
30 other charge not included in rent and the charges are billed

1 separately from rent, the landlord shall provide an itemized
2 bill that lists each charge as a distinct line item.
3 (f) Electricity usage disclosure.--Any charge for
4 electricity shall include the actual kilowatt-hour usage as
5 recorded by the submeter for the tenant's specific dwelling
6 unit.
7 (g) Income assistance program disclosure.--A landlord shall
8 provide residents with a notice with information regarding
9 applicable income-based assistance programs. The notice shall
10 include directions to the commission for the purpose of
11 accessing the comprehensive registry of available customer
12 assistance programs, grants and billing relief measures for
13 which the resident may be eligible.
14 (h) Technology use information.--A landlord shall provide
15 tenants with clear instructions and informational materials
16 explaining how to utilize any provided energy technology for the
17 purpose of energy efficiency, demand response and cost savings.
18 (i) Historical usage disclosure.--Prior to lease execution,
19 a landlord shall provide prospective tenants with a 12-month
20 history of electricity or water usage and associated costs for
21 the dwelling unit, if the data is available.
22 (j) Carbon reduction contribution.--
23 (1) A landlord operating a master-metered system with
24 submetering under this section shall provide a measurable
25 contribution toward the reduction of carbon associated with
26 the energy consumption of the property. The contribution may
27 be satisfied through one or more of the following methods, as
28 approved by the commission:
29 (i) On-site generation of renewable energy.
30 (ii) Procurement and retirement of renewable energy

1 credits or verified carbon offset credits.
2 (iii) Participation in a carbon reduction or clean
3 energy program approved by the commission.
4 (2) Any renewable energy credits or carbon offset
5 credits used to satisfy the requirement under paragraph (1)
6 shall be retired on behalf of the property or tenants through
7 the PJM Generation Attribute Tracking System or a
8 substantially similar tracking and retirement system approved
9 by the commission. Credits may not be double-counted or
10 resold after retirement.
11 (3) The commission may establish minimum contribution
12 levels, verification standards and reporting requirements to
13 ensure that carbon reductions are real, additional and
14 attributable to the master-metered property.
15 Section 2. This act shall take effect in 60 days.
