AN ACT
1 Amending Title 44 (Law and Justice) of the Pennsylvania
2 Consolidated Statutes, establishing the Domestic Violence
3 Home Security Grant Program; and imposing duties on the
4 Pennsylvania Commission on Crime and Delinquency.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Title 44 of the Pennsylvania Consolidated
8 Statutes is amended by adding a chapter to read:

19 § 7501. Scope of chapter.
1 This chapter relates to domestic violence home security
2 grants.
3 § 7502. Definitions.
4 The following words and phrases when used in this chapter
5 shall have the meanings given to them in this section unless the
6 context clearly indicates otherwise:
7 "Commission." The Pennsylvania Commission on Crime and
8 Delinquency.
9 "Domestic violence." Conduct constituting abuse as defined
10 in 23 Pa.C.S. § 6102 (relating to definitions).
11 "Eligible applicant." A victim of domestic violence.
12 "Program." The Domestic Violence Home Security Grant Program
13 established under section 7511 (relating to establishment of
14 program).
15 "Residential security measure." A product, service,
16 technology or structural improvement intended to enhance the
17 physical safety and security of a residence, including:
18 (1) A reinforced door or lock.
19 (2) A window lock or shatter-resistant glass.
20 (3) A security camera or surveillance system.
21 (4) An alarm system or monitoring service.
22 (5) Motion-detection lighting.
23 (6) A personal alarm device.

3 § 7511. Establishment of program.
4 The Domestic Violence Home Security Grant Program is
5 established in the commission.
6 § 7512. Administration of program.
7 The program shall make grants to eligible applicants to
8 improve the safety and security of their residences.
9 § 7513. Applications.
10 (a) Development and posting of form.--The commission shall
11 develop a form for an individual to use to apply for a grant
12 under the program. The form:
13 (1) Must contain:
14 (i) The name, address and contact information for
15 the applicant.
16 (ii) The requested amount of the grant.
17 (iii) The proposed use or uses of the grant.
18 (2) Shall be posted by the commission on its publicly
19 accessible Internet website.
20 (b) Submittal of completed form.--The commission shall
21 prescribe the manner in which a completed form must be submitted
22 to the commission for the applicant to receive a grant under the
23 program.
24 (c) Acceptance of completed form.--The commission shall
25 accept applications under this section on a rolling or annual
26 basis, as determined by the commission.
27 (d) Documentation.--
28 (1) As part of the application under this section, the
29 commission shall require reasonable documentation
30 demonstrating that the applicant is a victim of domestic

1 violence.
2 (2) Acceptable documentation under paragraph (1)
3 includes:
4 (i) A protection from abuse order issued in
5 accordance with 23 Pa.C.S. Ch. 61 (relating to protection
6 from abuse).
7 (ii) A police report or criminal complaint.
8 (iii) Certification from a domestic violence service
9 provider.
10 (iv) Any other documentation deemed sufficient by
11 the commission.
12 (e) Prioritization.--The commission may prioritize
13 applications based on risk factors, including:
14 (1) Recent separation from an abuser or an abusers
15 release from incarceration.
16 (2) The severity of prior threats or acts of violence.
17 (3) Violations of a protection order.
18 (4) The presence of children in the household.
19 (5) Any other factor indicating elevated risk of harm.
20 § 7514. Permissible uses of grant.
21 A grant under the program may be used to:
22 (1) Reduce the risk of repeat victimization by enabling
23 the victim of domestic violence to purchase and implement
24 effective residential security measures to deter further
25 abuse, harassment or intrusion.
26 (2) Enhance the safety of the victim of domestic
27 violence during periods of heightened risk, including
28 immediately following separation from an abuser or an
29 abuser's release from incarceration.
30 (3) Assist with other efforts to protect the victim of

1 domestic violence from future abuse, harassment or intrusion.
2 § 7515. Award or denial of grant.
3 (a) Review and determination.--The commission shall review
4 each completed application under this subchapter to determine
5 whether the applicant is a victim of domestic violence. For each
6 eligible applicant, the commission shall determine the amount
7 of the grant and any condition on the use or uses of the grant.
8 (b) Notice.--The commission shall provide the applicant with
9 notice of the determination under subsection (a). If the
10 commission denies, in full or in part, the request for a grant
11 under this subchapter, the commission shall provide the
12 applicant with reasons for the denial.
13 § 7516. Confidentiality.
14 Personally identifiable information of applicants under this
15 subchapter shall be confidential and shall not be subject to
16 public disclosure.
17 Section 2. This act shall take effect in 60 days.
