                                    AN ACT
 1   Amending Title 74 (Transportation) of the Pennsylvania
 2      Consolidated Statutes, in Multimodal Fund, further providing
 3      for project selection criteria.
 4      The General Assembly of the Commonwealth of Pennsylvania
 5   hereby enacts as follows:
 6      Section 1.    Section 2105 of Title 74 of the Pennsylvania
 7   Consolidated Statutes is amended to read:
 8   § 2105.   Project selection criteria.
 9      (a)    Selection criteria.--The Department of Transportation
10   shall award grants under section 2104(a)(1) (relating to use of
11   money in fund) on a competitive basis, subject to subsection
12   (b). The department may not reserve, designate or set aside a
13   specific level of funding or percentage of funds to an applicant
14   prior to the completion of the application process, nor may the
15   department designate a set percentage of funds to an applicant.
16      (b)    Recycled materials.--When awarding grants under
17   subsection (a), the department shall give priority to
18   applications for projects that will utilize recycled asphalt and
1   materials, including reclaimed asphalt pavement and recycled
2   asphalt shingles, in such mixed-use design as permitted by the
3   department.
4      Section 2.   This act shall take effect in 60 days.
