                                      AN ACT
 1   Amending Title 35 (Health and Safety) of the Pennsylvania
 2      Consolidated Statutes, in miscellaneous provisions relating
 3      to emergency management services, providing for exemption of
 4      records from access.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7      Section 1.     Title 35 of the Pennsylvania Consolidated
 8   Statutes is amended by adding a section to read:
 9   § 7715.    Exemption of records from access.
10      (a)    Right-to-Know Law.--
11             (1)   Except as provided under paragraph (2), records of a
12      volunteer EMS company, volunteer fire company or volunteer
13      rescue company shall be exempt from access under the
14      provisions of the act of February 14, 2008 (P.L.6, No.3),
15      known as the Right-to-Know Law.
16             (2)   Records or parts of records that are directly
17      associated with funding or resources provided by a local
18      municipality under the following shall be subject to access
 1      under the Right-to-Know Law:
 2                (i)    Section 1553 of the act of May 1, 1933 (P.L.103,
 3            No.69), known as The Second Class Township Code.
 4                (ii)     8 Pa.C.S. § 1202(56) (relating to specific
 5            powers).
 6                (iii)     11 Pa.C.S. § 12446 (relating to emergency
 7            services).
 8                (iv)     73 Pa.C.S. § 4359 (relating to emergency
 9            services).
10      (b)   Definitions.--As used in this section, the following
11   words and phrases shall have the meanings given to them in this
12   subsection unless the context clearly indicates otherwise:
13      "Volunteer EMS company."      As defined in section 7802
14   (relating to definitions).
15      "Volunteer fire company."      As defined in section 7802.
16      "Volunteer rescue company."       As defined in section 7802.
17      Section 2.      This act shall take effect in 60 days.
