                                       AN ACT
 1   Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
 2      act relating to the public school system, including certain
 3      provisions applicable as well to private and parochial
 4      schools; amending, revising, consolidating and changing the
 5      laws relating thereto," in early learning programs, further
 6      providing for definitions.
 7      The General Assembly of the Commonwealth of Pennsylvania
 8   hereby enacts as follows:
 9      Section 1.     The definition of "eligible student" in section
10   1511-D of the act of March 10, 1949 (P.L.30, No.14), known as
11   the Public School Code of 1949, is amended to read:
12   Section 1511-D.    Definitions.
13      The following words and phrases when used in this subarticle
14   shall have the meanings given to them in this section unless the
15   context clearly indicates otherwise:

17      "Eligible student."    A child who [is at least three years of
18   age and is younger than the entry age of kindergarten in the
19   school district of residence.] meets all of the following
1   requirements:
2          (1)   Is at least three years of age and is younger than
3      the entry age of kindergarten in the school district of
4      residence.
5          (2)   Resides in a household with an annual household
6      income that is not greater than 400% of the Federal poverty
7      level.

9      Section 2.   This act shall take effect in 60 days.
