AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, in minors, further providing for the
3 offense of sexual abuse of children.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. The definition of "child sexual abuse material"
7 in section 6312(g) of Title 18 of the Pennsylvania Consolidated
8 Statutes, amended October 29, 2024 (P.L.1095, No.125), is
9 amended to read:
10 § 6312. Sexual abuse of children.

12 (g) Definitions.--As used in this section, the following
13 words and phrases shall have the meanings given to them in this
14 subsection:

16 "Child sexual abuse material." Any of the following:
17 (1) A book, magazine, pamphlet, slide, photograph, film,
18 videotape, computer depiction or other material depicting a
1 child under 18 years of age engaging in a prohibited sexual
2 act or in the simulation of a prohibited sexual act.
3 (2) As follows:
4 (i) the lewd exhibition of the genitals or pubic
5 area of an unclothed, partially clothed or clothed child
6 under 18 years of age in a patently offensive or sexually
7 suggestive manner;
8 (ii) material which the average person applying
9 contemporary community standards would find that the
10 subject matter taken as a whole appeals to the prurient
11 interest in sex; and
12 (iii) material which the subject matter, taken as a
13 whole, lacks serious literary, artistic, political,
14 educational or scientific value.

16 Section 2. This act shall take effect in 60 days.
