AN ACT
1 Amending the act of April 17, 2016 (P.L.84, No.16), entitled "An
2 act establishing a medical marijuana program; providing for
3 patient and caregiver certification and for medical marijuana
4 organization registration; imposing duties on the Department
5 of Health; providing for a tax on medical marijuana
6 organization gross receipts; establishing the Medical
7 Marijuana Program Fund; establishing the Medical Marijuana
8 Advisory Board; establishing a medical marijuana research
9 program; imposing duties on the Department of Corrections,
10 the Department of Education and the Department of Human
11 Services; and providing for academic clinical research
12 centers and for penalties and enforcement," in medical
13 marijuana controls, further providing for grower/processors;
14 and, in dispensaries, further providing for facility
15 requirements.
16 The General Assembly of the Commonwealth of Pennsylvania
17 hereby enacts as follows:
18 Section 1. Sections 702(b)(2) and 802(a)(1.1) of the act of
19 April 17, 2016 (P.L.84, No.16), known as the Medical Marijuana
20 Act, are amended to read:
21 Section 702. Grower/processors.

23 (b) Limitations.--

1 (2) For the [purpose] purposes of paragraph (1), a
2 grower/processor shall maintain continuous video surveillance
3 equipment in continuous operation. A grower/processor is
4 required to retain the recordings onsite or offsite for a
5 period of no less than 180 days, unless otherwise required
6 for investigative or litigation purposes.

8 Section 802. Facility requirements.
9 (a) General rule.--

11 (1.1) For the purposes of paragraph (1), a dispensary
12 shall maintain continuous video surveillance equipment in
13 continuous operation. The dispensary is required to retain
14 the recordings onsite or offsite for a period of no less than
15 180 days, unless otherwise required for investigative or
16 litigation purposes.

18 Section 2. This act shall take effect in 60 days.
