                                     AN ACT
 1   Authorizing the Department of General Services, with the
 2      approval of the Governor, to grant and convey to Susquehanna
 3      Regional Transportation Authority certain lands situate in
 4      the City of Harrisburg, Dauphin County.
 5      The General Assembly of the Commonwealth of Pennsylvania
 6   hereby enacts as follows:
 7   Section 1.    Conveyance in the City of Harrisburg, Dauphin
 8                 County.
 9      (a)     Authorization.--The Department of General Services, with
10   the approval of the Governor, is hereby authorized on behalf of
11   the Commonwealth of Pennsylvania to grant and convey to the
12   Susquehanna Regional Transportation Authority certain land and
13   buildings situate in the City of Harrisburg, Dauphin County, for
14   $340,000, under terms and conditions to be established in an
15   agreement of sale.
16      (b)     Property description.--The property to be conveyed under
17   subsection (a) consists of approximately 2.857 acres and
18   improvements thereon, bounded and more particularly described as
19   follows:
 1      ALL THAT CERTAIN tract of land situate in the City of
 2   Harrisburg, Dauphin County, Pennsylvania, being more fully
 3   bounded and described as follows, to wit:
 4      All that certain tract of land situate in the City of
 5   Harrisburg, Dauphin County, Pennsylvania, according to a survey
 6   prepared by Susquehanna Civil Inc, dated August 18, 2022, and
 7   being more fully bounded and described as follows, to wit:
 8      Beginning at a 5/8" rebar set on the eastern legal right-of-
 9   way line of North Cameron Street, and being South 15 degrees 16
10   minutes 47 seconds East for a distance of 300.91 feet from the
11   southerly right-of-way line of Goodwill Drive;
12      THENCE North 60 degrees 52 minutes 36 seconds East for a
13   distance of 123.71 feet to a point on the eastern legal right-
14   of-way line of Florence Street;
15      THENCE along the eastern legal right-of-way line of Florence
16   Street, North 15 degrees 16 minutes 55 seconds West for a
17   distance of 271.31 feet to a 5/8" rebar found at the
18   intersection of the southern legal right-of-way line of Goodwill
19   Drive and the eastern legal right-of-way line of Florence
20   Street;
21      THENCE along the southern legal right-of-way line of Goodwill
22   Drive, North 74 degrees 43 minutes 05 seconds East for a
23   distance of 384.00 feet to a 5/8" rebar at the intersection of
24   the southern legal right-of-way line of Goodwill Drive and the
25   western legal right-of-way line of Dr. Claude E. Nichols Street;
26      THENCE along the western legal right-of-way line of Dr.
27   Claude E. Nichols Street, South 15 degrees 16 minutes 55 seconds
28   East for a distance of 176.70 feet to a 5/8" rebar set;
29      THENCE North 60 degrees 52 minutes 36 seconds East for a
30   distance of 33.78 feet to a 5/8" rebar set on the line of lands

 1   of the Harrisburg Cemetery Association;
 2      THENCE along the lands of the Harrisburg Cemetery
 3   Association, South 16 degrees 39 minutes 58 seconds East for a
 4   distance of 61.58 feet to a point in the State Street Ramp from
 5   North Cameron Street to 13th Street;
 6      THENCE in and through the said State Street Ramp, South 58
 7   degrees 58 minutes 47 seconds West for a distance of 559.38 feet
 8   to a point on the eastern legal right-of-way line of North
 9   Cameron Street;
10      THENCE along the eastern legal right-of-way line of North
11   Cameron Street, North 15 degrees 16 minutes 47 seconds West for
12   a distance of 81.00 feet to the place of beginning.
13      Containing 2.857 acres or 124,449 square feet, gross.
14      (c)   Subject to certain matters.--The conveyance shall be
15   made under and subject to all lawful and enforceable easements,
16   servitudes and rights of others, including, but not confined to,
17   highway rights-of-way, including without limitation the right-
18   of-way for the State Street Bridge, SR 3014, and the right-of-
19   way for the ramp to 13th Street adjoining such bridge, SR 3028,
20   streets, roadways and rights of any telephone, telegraph, water,
21   electric, gas or pipeline companies, as well as under and
22   subject to any lawful and enforceable estates or tenancies
23   vested in third persons appearing of record, for any portion of
24   the land or improvements erected thereon.
25      (d)   Prohibitions.--Any conveyance authorized under this
26   section shall be made under and subject to the condition, which
27   shall be contained in the deed of conveyance, that no portion of
28   the property conveyed shall be used as a licensed facility, as
29   defined in 4 Pa.C.S. § 1103 (relating to definitions), or any
30   other similar type of facility authorized under State law. The

 1   condition shall be a covenant running with the land and shall be
 2   binding upon the grantee, its successors and assigns. Should the
 3   grantee, its successors or assigns, permit any portion of the
 4   property authorized to be conveyed in this section to be used in
 5   violation of this subsection, the title shall immediately revert
 6   to and revest in the grantor.
 7      (e)   Conditions and restrictions.--The Secretary of General
 8   Services may include in the deed of conveyance any covenants,
 9   conditions or restrictions on the property as determined to be
10   in the best interests of the Commonwealth.
11      (f)   Easements.--The Department of General Services is hereby
12   authorized, on behalf of the Commonwealth of Pennsylvania, to
13   grant any easements benefiting the property to be conveyed, or
14   to retain any easements from the property to be conveyed, as the
15   Secretary of General Services shall determine to be necessary or
16   appropriate.
17      (g)   Deed.--The conveyance shall be made by special warranty
18   deed to be executed by the Secretary of General Services in the
19   name of the Commonwealth of Pennsylvania.
20      (h)   Costs and fees.--Costs and fees incidental to this
21   conveyance shall be borne by the grantee.
22      (i)   Alternative disposition.--In the event that this
23   conveyance is not executed within 24 months after the effective
24   date of this subsection, the property may be disposed of by a
25   competitive bidding process in accordance with section 2405-A of
26   the act of April 9, 1929 (P.L.177, No.175), known as The
27   Administrative Code of 1929, except that no property disposition
28   plan shall be required.
29      (j)   Proceeds.--The proceeds from the conveyance authorized
30   by this section shall be deposited into the General Fund.
