AN ACT
1 Amending Title 74 (Transportation) of the Pennsylvania
2 Consolidated Statutes, in public utility facilities, further
3 providing for adjustment.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 9501 of Title 74 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 9501. Adjustment.
9 (a) General rule.--The following shall apply:
10 (1) If, in the construction, reconstruction, widening or
11 relocation of a State highway, bridge or tunnel or a part of
12 a State highway, bridge or tunnel, it becomes necessary, in
13 the opinion of the Department of Transportation, to change,
14 alter, adjust or relocate a water line or sanitary sewer
15 owned and operated by a public utility, as defined in 66
16 Pa.C.S. § 102 (relating to definitions), or infrastructure of
17 a local exchange telecommunications company cable television
18 system or provider of telecommunications services, the
1 department may, with the written agreement of the public
2 utility or owner of the infrastructure, make the change,
3 alteration, adjustment or relocation as may be required as a
4 part of the construction, reconstruction, widening or
5 relocation.
6 (2) In addition to paragraph (1), the department may
7 also enter into agreements with the public utility or owner
8 of the infrastructure for the sharing of costs of the change,
9 alteration, adjustment or relocation. If, in the opinion of
10 the department, the costs should be shared by the department
11 and [a] the public utility or owner of the infrastructure and
12 the department is unable to agree with the public utility or
13 owner of the infrastructure to a division of costs, the
14 department may proceed with the work and petition the
15 Pennsylvania Public Utility Commission for a determination of
16 the costs to be borne by each party.
17 (b) Declaration of policy.--[A] The public utility or owner
18 of the infrastructure under subsection (a) shall be entitled to
19 a reimbursement in a similar manner as a city, borough,
20 incorporated town, township and municipal authority under
21 section 412.1 of the act of June 1, 1945 (P.L.1242, No.428),
22 known as the State Highway Law.
23 Section 2. This act shall take effect in 60 days.
