                                    AN ACT
 1   Amending the act of December 21, 1989 (P.L.672, No.87), entitled
 2      "An act providing for the regulation of health club
 3      contracts; and providing for further duties of the Bureau of
 4      Consumer Protection, the Attorney General and district
 5      attorneys," providing for lifeguards.
 6      The General Assembly of the Commonwealth of Pennsylvania
 7   hereby enacts as follows:
 8      Section 1.    The act of December 21, 1989 (P.L.672, No.87),
 9   known as the Health Club Act, is amended by adding a section to
10   read:
11   Section 14.1.    Lifeguards.
12      (a)   Number of certified lifeguards.--A health club that
13   provides a swimming pool for use by members and guests shall
14   have on duty at least one certified lifeguard for each swimming
15   pool that has a water surface area of 1,500 square feet or
16   larger during hours that the swimming pool is open for general
17   swimming purposes to members or guests of the health club.
18      (b)   Definitions.--As used in this section, the following
1   words and phrases shall have the meanings given to them in this
2   subsection unless the context clearly indicates otherwise:
3      "Certified lifeguard."   An individual who has a current
4   certificate in lifeguarding, issued by a lifeguard certifying
5   authority, as recognized by the Department of Health.
6      Section 2.   This act shall take effect in 60 days.
