                                    AN ACT
 1   Amending the act of October 18, 1988 (P.L.756, No.108), entitled
 2      "An act providing for the cleanup of hazardous waste sites;
 3      providing further powers and duties of the Department of
 4      Environmental Resources and the Environmental Quality Board;
 5      providing for response and investigations for liability and
 6      cost recovery; establishing the Hazardous Sites Cleanup Fund;
 7      providing for certain fees and for enforcement, remedies and
 8      penalties; and repealing certain provisions relating to the
 9      rate of the capital stock franchise tax," in preliminary
10      provisions, further providing for definitions; and, in
11      miscellaneous, providing for release testing and
12      reimbursement.
13      The General Assembly of the Commonwealth of Pennsylvania
14   hereby enacts as follows:
15      Section 1.    The definition of "department" in section 103 of
16   the act of October 18, 1988 (P.L.756, No.108), known as the
17   Hazardous Sites Cleanup Act, is amended to read:
18   Section 103.    Definitions.
19      The following words and phrases when used in this act shall
20   have the meanings given to them in this section unless the
21   context clearly indicates otherwise:

 1      "Department."     The Department of Environmental [Resources]
 2   Protection of the Commonwealth.
 3      * * *
 4      Section 2.     The act is amended by adding a section to read:
 5   Section 1303.1.    Release testing and reimbursement.
 6      (a)   Release testing.--Release from identified contaminated
 7   sites shall be tested annually by the person that owns the site,
 8   including releases of hazardous substances expressly and
 9   specifically approved under a valid Federal or State permit.
10      (b)   Reimbursement.--An owner of an identified contaminated
11   site shall reimburse the department as provided for in section
12   507.
13      (c)   Definitions.--As used in this section, the following
14   words and phrases shall have the meanings given to them in this
15   subsection unless the context clearly indicates otherwise:
16      "Identified contaminated site."      A site which contains
17   hazardous or dangerous substances at levels above normal
18   background levels which pose a risk to human health or the
19   environment, including Federal Superfund sites.
20      Section 3.     This act shall take effect in 60 days.
