                                  AN ACT
 1   Amending the act of April 9, 1929 (P.L.343, No.176), entitled
 2      "An act relating to the finances of the State government;
 3      providing for cancer control, prevention and research, for
 4      ambulatory surgical center data collection, for the Joint
 5      Underwriting Association, for entertainment business
 6      financial management firms, for private dam financial
 7      assurance and for reinstatement of item vetoes; providing for
 8      the settlement, assessment, collection, and lien of taxes,
 9      bonus, and all other accounts due the Commonwealth, the
10      collection and recovery of fees and other money or property
11      due or belonging to the Commonwealth, or any agency thereof,
12      including escheated property and the proceeds of its sale,
13      the custody and disbursement or other disposition of funds
14      and securities belonging to or in the possession of the
15      Commonwealth, and the settlement of claims against the
16      Commonwealth, the resettlement of accounts and appeals to the
17      courts, refunds of moneys erroneously paid to the
18      Commonwealth, auditing the accounts of the Commonwealth and
19      all agencies thereof, of all public officers collecting
20      moneys payable to the Commonwealth, or any agency thereof,
21      and all receipts of appropriations from the Commonwealth,
22      authorizing the Commonwealth to issue tax anticipation notes
23      to defray current expenses, implementing the provisions of
24      section 7(a) of Article VIII of the Constitution of
25      Pennsylvania authorizing and restricting the incurring of
26      certain debt and imposing penalties; affecting every
27      department, board, commission, and officer of the State
28      government, every political subdivision of the State, and
29      certain officers of such subdivisions, every person,
30      association, and corporation required to pay, assess, or
31      collect taxes, or to make returns or reports under the laws
32      imposing taxes for State purposes, or to pay license fees or
33      other moneys to the Commonwealth, or any agency thereof,
34      every State depository and every debtor or creditor of the
 1      Commonwealth," in general budget implementation, further
 2      providing for Department of Human Services.
 3      The General Assembly of the Commonwealth of Pennsylvania
 4   hereby enacts as follows:
 5      Section 1.        Section 1729-E(b) of the act of April 9, 1929
 6   (P.L.343, No.176), known as The Fiscal Code, is amended to read:
 7   Section 1729-E.        Department of Human Services.
 8      * * *
 9      (b)   Home and Community-Based Services for Individuals with
10   Intellectual Disabilities Augmentation Account.--
11            (1)   A restricted account is established in the General
12      Fund to be known as the Home and Community-Based Services for
13      Individuals with Intellectual Disabilities Augmentation
14      Account.
15            (2)   Money in the account shall not lapse.
16            (3)   The following shall be deposited in the account:
17                  (i)    The net proceeds of the sale of real property
18            which served as a state center for individuals with
19            intellectual disabilities.
20                  (ii)    An annual transfer from the General Fund to the
21            account in accordance with the following:
22                         (A)   If the amount of the appropriation for state
23                  centers for individuals with intellectual
24                  disabilities in a fiscal year is less than the amount
25                  of [the] an appropriation for [the] a prior fiscal
26                  year, the Secretary of the Budget shall certify the
27                  difference as the amount to be transferred.
28                         (A.1)   For each fiscal year after the sale of
29                  real property which served as a state center for
30                  individuals with intellectual disabilities, the
31                  secretary shall certify the amount of maintenance

 1                costs, upkeep and operational costs that would
 2                otherwise have been expended for the state center for
 3                individuals with intellectual disabilities had it
 4                remained open and operational. The amount certified
 5                under this clause shall be transferred.
 6                     (B)   [The] A transfer under this subparagraph
 7                shall be made no later than last day of the first
 8                quarter of a fiscal year.
 9                (iii)   Any amounts appropriated or transferred to the
10          account.
11          (4)   Money in the account is hereby appropriated to the
12      Department of Human Services to provide home and community-
13      based supports, including quality direct support professional
14      capacity, to provide housing supports for individuals with
15      intellectual disabilities and to provide home and community-
16      based supports for people on the emergency waiting list as of
17      the first day of a fiscal year as determined by the
18      department after receiving input from the Office of
19      Developmental Programs and the Information Sharing and
20      Advisory Committee.
21      Section 2.   This act shall take effect July 1, 2025, or
22   immediately, whichever is later.
