AN ACT
1 Amending Title 58 (Oil and Gas) of the Pennsylvania Consolidated
2 Statutes, in development, providing for hydraulic fracturing
3 fluid tracer.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 58 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 3222.2. Hydraulic fracturing fluid tracer.
9 (a) Applicability.--This section shall apply to hydraulic
10 fracturing of unconventional wells performed on or after the
11 effective date of this subsection.
12 (b) Required additives.--A service provider who performs any
13 part of a hydraulic fracturing treatment and a vendor who
14 provides hydraulic fracturing chemicals directly to the operator
15 for a hydraulic fracturing treatment shall include a tracer
16 substance in the base stimulation fluid used in the alteration
17 of an unconventional well.
18 (c) Specifications.--The department shall specify the type
1 of tracer substance that the operator is required to use in the
2 alteration of an unconventional well. The following shall apply:
3 (1) The tracer substance must be traceable to a specific
4 operator after the tracer substance is used in the alteration
5 of an unconventional well.
6 (2) The department shall determine that the use of the
7 tracer substance will not endanger public health or the
8 environment.
9 (d) Regulations.--The Environmental Quality Board shall
10 promulgate regulations necessary to meet the requirements of
11 this section.
12 Section 2. This act shall take effect immediately.
