AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, in special vehicles and pedestrians, providing for
3 shared low-speed electric scooters; and imposing penalties.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Chapter 35 of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subchapter to read:
8 SUBCHAPTER B.1
9 SHARED LOW-SPEED ELECTRIC SCOOTERS

3 § 3531. Definitions.
4 The following words and phrases when used in this subchapter
5 shall have the meanings given to them in this section unless the
6 context clearly indicates otherwise:
7 "Abandoned shared low-speed electric scooter." A shared low-
8 speed electric scooter that meets all of the following:
9 (1) The user of the shared low-speed electric scooter is
10 not visible to an individual making an initial report on a
11 hotline that the shared low-speed electric scooter is
12 abandoned.
13 (2) The shared low-speed electric scooter is illegally
14 parked on a highway or is on property where the shared low-
15 speed electric scooter is prohibited to be used or kept under
16 this subchapter or an applicable municipal ordinance or
17 executive order.
18 "Authorized municipality." Any of the following:
19 (1) A city of the second class.
20 (2) A city of the second class A.
21 (3) A city of the third class.
22 "Commercial shared low-speed electric scooter enterprise." A
23 person that makes shared low-speed electric scooters available
24 for rent to the public for use under a program.
25 "Hotline." A complaint hotline established under section
26 3533(b)(2) (relating to shared low-speed electric scooter
27 program).
28 "Low-speed electric scooter." As follows:
29 (1) A device weighing less than 100 pounds that:
30 (i) has handlebars and an electric motor;

1 (ii) has a floorboard on which a person may stand
2 while riding or a seat on which a person may sit while
3 riding; and
4 (iii) is powered solely by the electric motor or
5 human power, or both.
6 (2) The term does not include a pedalcycle with electric
7 assist, electric personal assistive mobility device,
8 motorcycle, motorized pedalcycle or motor-driven cycle.
9 "Program." A shared low-speed electric scooter program
10 authorized under section 3533(a).
11 "Shared low-speed electric scooter." A low-speed electric
12 scooter made available for rent to the public by a commercial
13 shared low-speed electric scooter enterprise under a program.
14 § 3532. Oversight.
15 The department shall have primary responsibility for
16 oversight of all of the following:
17 (1) Shared low-speed electric scooters operating in this
18 Commonwealth.
19 (2) Programs established by authorized municipalities.
20 (3) The adoption by authorized municipalities of
21 required ordinances, amendments to required ordinances and
22 subsequent policies to ensure compliance with this
23 subchapter.
24 § 3533. Shared low-speed electric scooter program.
25 (a) Authorization.--An authorized municipality may establish
26 a shared low-speed electric scooter program with a commercial
27 shared low-speed electric scooter enterprise within the
28 boundaries of the authorized municipality in accordance with
29 this subchapter.
30 (b) Ordinance.--Before establishing a program, an authorized

1 municipality shall adopt an ordinance that includes all of the
2 following:
3 (1) Policies providing all of the following:
4 (i) An individual operating a shared low-speed
5 electric scooter under a program shall be granted all of
6 the rights and shall be subject to all of the duties
7 applicable to the operator of a pedalcycle under
8 Subchapter A (relating to operation of pedalcycles).
9 (ii) A shared low-speed electric scooter may operate
10 on a highway, pedalcycle lane on a highway or pedalcycle
11 path owned by the Commonwealth or an authorized
12 municipality within the boundaries of the authorized
13 municipality.
14 (iii) Subject to subparagraph (iv)(C), an individual
15 may not operate a shared low-speed electric scooter on a
16 sidewalk unless the shared low-speed electric scooter is
17 upright and properly docked in a designated parking area
18 as determined by the authorized municipality.
19 (iv) An individual may not operate a shared low-
20 speed electric scooter on any of the following:
21 (A) A freeway.
22 (B) A highway with a posted speed limit of 35
23 miles per hour or more.
24 (C) A sidewalk in a business district.
25 (v) An individual under 16 years of age may not
26 operate a shared low-speed electric scooter.
27 (vi) An individual may not operate a shared low-
28 speed electric scooter at a speed greater than 15 miles
29 per hour.
30 (vii) When operated between sunset and sunrise, a

1 shared low-speed electric scooter shall be equipped with
2 all of the following:
3 (A) A lamp on the front that emits a beam of
4 white light intended to illuminate the path of the
5 shared low-speed electric scooter and is visible from
6 a distance of at least 500 feet to the front.
7 (B) A red lamp facing to the rear that is
8 visible from a distance of at least 500 feet to the
9 rear.
10 (C) A reflector on each side.
11 (viii) A commercial shared low-speed electric
12 scooter enterprise shall provide information on customer
13 support service for approval by the authorized
14 municipality.
15 (2) Provisions establishing a complaint hotline in
16 accordance with all of the following:
17 (i) The hotline shall be used to report any of the
18 following:
19 (A) Abandoned shared low-speed electric
20 scooters.
21 (B) Violations of this subchapter or the
22 ordinance.
23 (ii) The hotline telephone number shall be displayed
24 on each shared low-speed electric scooter.
25 (iii) The hotline may operate through an existing
26 municipal response center operated by the authorized
27 municipality.
28 (3) Requirements addressing all of the following:
29 (i) Geofencing.
30 (ii) Rider limits.

1 (iii) Fleet size.
2 (iv) Vehicle maintenance information.
3 (v) Strategies to reduce negative interactions
4 between riders of shared low-speed electric scooters and
5 pedestrians.
6 (vi) Installation and maintenance of parking and
7 charging stations.
8 (vii) Data management and reporting.
9 (viii) Education, public awareness and public
10 participation plans.
11 (ix) Fare structure.
12 (c) Amendments and policy changes.--An authorized
13 municipality may amend an ordinance adopted under subsection (b)
14 or adopt a subsequent policy consistent with this subchapter to
15 improve operation of the program or further protect public
16 safety.
17 (d) Notice.--An authorized municipality that adopts an
18 ordinance under subsection (b) or an amendment or policy under
19 subsection (c) shall notify the department of the adoption.
20 § 3534. Insurance.
21 (a) Requirement.--A commercial shared low-speed electric
22 scooter enterprise operating in an authorized municipality shall
23 provide the authorized municipality with proof of insurance
24 coverage required under this section.
25 (b) Coverage amounts.--A commercial shared low-speed
26 electric scooter enterprise shall maintain all of the following
27 insurance coverage:
28 (1) Commercial general liability insurance with a limit
29 of at least $2,000,000 for each occurrence and $2,000,000 in
30 the aggregate.

1 (2) Automobile insurance with a limit of at least
2 $1,000,000 for each occurrence and $1,000,000 in the
3 aggregate.
4 (3) If the commercial shared low-speed electric scooter
5 enterprise employs an individual, workers' compensation
6 coverage in an amount not less than required by Federal or
7 State law.
8 § 3535. Safety issues.
9 If a program includes the use of a highway owned by or under
10 the jurisdiction of the department, the department may
11 permanently or temporarily restrict access to a segment of the
12 highway under the program if the department identifies a pattern
13 of safety issues that cannot be reasonably corrected. The
14 department shall establish a process to:
15 (1) Examine the safety issue, including evaluation of
16 accidents and damage to property on the highway.
17 (2) Communicate the safety issue to, and consult with,
18 the authorized municipality and commercial shared low-speed
19 electric scooter enterprise before restricting access.
20 § 3536. Labor peace agreements.
21 (a) Agreement required.--To ensure uninterrupted service and
22 minimize labor disputes, an operator or service provider of
23 shared low-speed electric scooters shall present a fully
24 executed labor peace agreement with a labor organization
25 representing the operator's or service provider's employees as
26 part of the operator's or service provider's license application
27 or within 90 days after being informed of the representation if
28 the employees were not previously represented by the labor
29 organization.
30 (b) Availability.--A labor peace agreement shall be made

1 available upon request.
2 (c) Labor disputes.--In the event of a labor dispute, an
3 operator or service provider of shared low-speed electric
4 scooters shall take all reasonable steps to maintain service
5 levels and minimize the impact on the public.
6 § 3537. Enforcement.
7 In addition to a fine or penalty relating to a pedalcycle
8 under Subchapter A (relating to operation of pedalcycles), an
9 authorized municipality may impose one or more of the following:
10 (1) A fine of not more than $50 for failure to operate a
11 shared low-speed electric scooter in compliance with this
12 subchapter.
13 (2) A fine of not more than $150 for failure to park a
14 shared low-speed electric scooter in compliance with this
15 subchapter.
16 (3) A fine of not more than $150 per day on a commercial
17 shared low-speed electric scooter enterprise for each
18 abandoned shared low-speed electric scooter that is not
19 collected and returned to a corral or storage area within
20 three hours after the shared low-speed electric scooter is
21 abandoned.
22 (4) A civil penalty of not more than $1,000 for each day
23 that a commercial shared low-speed electric scooter
24 enterprise operates without the insurance required under
25 section 3534 (relating to insurance). A civil penalty
26 collected under this paragraph shall be used by the
27 authorized municipality for the safety, operation and
28 management of shared low-speed electric scooters or
29 pedalcycles.
30 § 3538. Police powers.

1 Nothing in this subchapter shall be construed to do either of
2 the following:
3 (1) Limit the reasonable exercise of police power to
4 regulate and enforce the use of shared low-speed electric
5 scooters in accordance with this subchapter and the
6 regulation of pedalcycles, as applicable.
7 (2) Prevent the department, on a State-designated
8 highway, or a local authority, on a local-designated highway,
9 from reasonably exercising police powers in accordance with
10 section 6109 (relating to specific powers of department and
11 local authorities).
12 § 3539. Reports.
13 (a) Requirement.--Each authorized municipality that
14 establishes a program, in coordination with the department,
15 shall prepare an annual report on the deployment of shared low-
16 speed electric scooters under the program.
17 (b) Contents.--A report under this section shall include all
18 of the following:
19 (1) The number of rides.
20 (2) The number of accidents.
21 (3) The frequency of use.
22 (4) An ordinance, regulation or policy adopted in
23 accordance with this subchapter.
24 (c) Submission.--A report under this section shall be
25 submitted to all of the following:
26 (1) The chairperson and minority chairperson of the
27 Transportation Committee of the Senate.
28 (2) The chairperson and minority chairperson of the
29 Transportation Committee of the House of Representatives.
30 (d) Posting.--The department and the authorized municipality

1 shall post the report on their publicly accessible Internet
2 websites.
3 § 3540. Applicability and construction.
4 (a) Certificate of title and registration.--Notwithstanding
5 Subchapter A of Chapter 11 (relating to certificate of title) or
6 Subchapter A of Chapter 13 (relating to general provisions), a
7 shared low-speed electric scooter authorized under this
8 subchapter shall not be subject to the certificate of title or
9 vehicle registration requirements under this title.
10 (b) Motor vehicle.--A shared low-speed electric scooter
11 authorized under this subchapter shall not be construed to be a
12 motor vehicle.
13 (c) Private ownership.--Nothing in this subchapter shall be
14 construed to prohibit a person that is not a commercial shared
15 low-speed electric scooter enterprise from owning or operating a
16 low-speed electric scooter. The person shall not be subject to a
17 requirement under this subchapter that applies specifically to a
18 commercial shared low-speed electric scooter enterprise.
19 Section 2. This act shall apply as follows:
20 (1) For an authorized municipality that is a city of the
21 second class, the addition of 75 Pa.C.S. Ch. 35 Subch. B.1
22 shall apply immediately.
23 (2) For an authorized municipality that is a city of the
24 second class A or a city of the third class, the addition of
25 75 Pa.C.S. Ch. 35 Subch. B.1 shall apply 60 days after the
26 effective date of this section.
27 Section 3. This act shall take effect immediately.
