AN ACT
1 Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
2 Statutes, in food protection, providing for food allergy
3 awareness program.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5705 of Title 3 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 5705. [(Reserved).] Food allergy awareness program.
9 (a) Establishment.--The Department of Health shall establish
10 a food allergy awareness program. The food allergy awareness
11 program shall require a public eating or drinking place to
12 comply with all of the following:
13 (1) Prominently display a poster developed by the
14 Department of Health under subsection (b) in the staff area
15 that provides information on food allergy awareness.
16 (2) Include on a food menu a notice to a customer of the
17 customer's obligation to inform a server about the customer's
18 food allergy.
1 (b) Language.--The Department of Health, in consultation
2 with the Food Allergy and Anaphylaxis Network, shall develop the
3 poster required under subsection (a)(1) and approve the
4 information on the poster.
5 Section 2. This act shall take effect in 60 days.
