AN ACT
1 Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
2 Statutes, in retail food facility safety, further providing
3 for license required.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5703(b)(2) of Title 3 of the Pennsylvania
7 Consolidated Statutes is amended by adding subparagraphs to
8 read:
9 § 5703. License required.

11 (b) Exempt retail food facilities.--

13 (2) A licensor shall exempt the following retail food
14 facilities from the license requirements of this section:

16 (iv) A retail food facility owned by a charitable
17 nonprofit entity that operates on no more than 12 days
18 each calendar year.
1 (v) A retail food facility under paragraph (1)(vii)
2 that operates on no more than 12 days each calendar year.

4 Section 2. This act shall take effect in 60 days.
