AN ACT
1 Amending Title 23 (Domestic Relations) of the Pennsylvania
2 Consolidated Statutes, in alimony and support, further
3 providing for alimony pendente lite, counsel fees and
4 expenses.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 3702(b) of Title 23 of the Pennsylvania
8 Consolidated Statutes is amended to read:
9 § 3702. Alimony pendente lite, counsel fees and expenses.

11 (b) Exception.--Except where the court finds that an order
12 for alimony pendente lite or spousal support is necessary to
13 prevent manifest injustice, a party who has been convicted of
14 committing a personal injury crime against the other party shall
15 not be entitled to spousal support or alimony pendente lite. In
16 determining whether manifest injustice exists, the court shall
17 review whether there is a history of harassment by a party or a
18 history of any protection from abuse order against a party. Any
19 amount paid by the injured party after the commission of the
1 offense but before the conviction of the other party shall be
2 recoverable by the injured party upon petition.
3 Section 2. The amendment of 23 Pa.C.S. § 3702(b) shall apply
4 to a proceeding commenced on or after the effective date of this
5 section.
6 Section 3. This act shall take effect in 60 days.
