AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, in other offenses, further providing
3 for drug trafficking sentencing and penalties.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 7508 of Title 18 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 7508. Drug trafficking sentencing and penalties.
9 * * *
10 (g) Sentencing enhancement.--The Pennsylvania Commission on
11 Sentencing, in accordance with 42 Pa.C.S. § 2154 (relating to
12 adoption of guidelines for sentencing), shall provide for a
13 sentencing enhancement for courts to consider in cases involving
14 a person violating section 13(a)(12), (14) or (30) of The
15 Controlled Substance, Drug, Device and Cosmetic Act where the
16 controlled substance or a mixture containing it is classified in
17 Schedule I, II, III or IV under section 4 of that act if the
18 person manufactures, delivers or possesses with the intent to
1 manufacture or deliver the controlled substance within 1,000
2 feet of the real property on which a drug and alcohol recovery
3 house is located. As used in this subsection, the term "drug and
4 alcohol recovery house" shall be as defined in section 2311-A of
5 the act of April 9, 1929 (P.L.177, No.175), known as The
6 Administrative Code of 1929.
7 Section 2. This act shall take effect in 60 days.
